Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Global War on Terrorism Service Medal and a bronze service star related to his Kosovo Campaign Medal. 2. He states these awards are missing from his DD Form 214. 3. He provides his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 30 June 1999, the applicant enlisted in the Regular Army. After completing initial entry training, he was awarded military occupational specialty 88M (Motor Transport Operator). 3. His record contains a DA Form 638 (Recommendation for Award) that shows Permanent Orders awarded him the Army Achievement Medal for the period 5 December 1999 to 4 December 2001. Noted among his achievements is a four- month deployment in support of Task Force Falcon. 4. On 15 October 2003, he was honorably released from active duty after completing 4 years, 4 months, and 16 days of net active service. His DD Form 214 shows he was awarded or authorized: * North Atlantic Treaty Organization Medal * Army Achievement Medal (3rd Award) * Army Good Conduct Medal * National Defense Service Medal * Kosovo Campaign Medal * Army Service Ribbon * Overseas Service Ribbon * Expert Marksmanship Qualification Badge with Rifle and Grenade Bars b. item 18 (Remarks) the entry "SERVICE IN KOSOVO: 20000226- 20000626" REFERENCES: Army Regulation (AR) 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the area of eligibility (AOE) designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal. b. The Kosovo Campaign Medal is awarded to Service members of the Armed Forces of the United States who, after 24 March 1999, participated in or served in direct support of Kosovo Operation(s): Allied Force; Joint Guardian; Allied Harbour; Sustain Hope/Shining Hope; Noble Anvil; or Kosovo Task Force(s): Saber, Hunter, Hawk or Falcon within the Kosovo Air Campaign or Kosovo Defense Campaign areas of eligibility. One bronze service star will be worn for participation in each campaign. His service coincides with the Kosovo Defense Campaign – 11June 1999 to 31 December 2013. DISCUSSION: 1. The applicant was awarded the Kosovo Campaign Medal and his DD Form 214 and his DA Form 638 confirm his participation in one campaign. He meets the criteria for award of one bronze service star for wear on his previously- awarded Kosovo Campaign Medal. 2.
