ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 29 March 2019 DOCKET NUMBER: AR20160018673 APPLICANT REQUESTS: correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as " XXX-XX-XXXX " instead of " XXX-XX-XXXX." APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Social Security Administration (SSA) card FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, he did not know his correct SSN at the time of his initial enlistment and he was given a temporary SSN when he enlisted. He now has his correct SSN and request his record to show his SSN as " XXX-XX-XXXX." 3. On 20 November 1974, the applicant enlisted into the Regular Army. He was released from active duty on 14 January 1982 and transferred to the United States Army Reserve (USAR) Control Group (Reinforcement). All of the records and documents in his military record show his SSN listed as " XXX-XX-XXXX." These documents include but are not limited to the following records: * DD Form 398 (Statement of Personal history, dated 29 October 1974 * Two, DD Form 4 (Enlistment Contract-Armed Forces of the United States) * DD Form 1584 (National Agency Check request), dated 21 November 1974) * DA Form 428 (Application for Identification Card), dated 3 November 1975 * DD Form 4 (Enlistment or Reenlistment Agreement - Armed Forces of the United States), dated 12 January 1978 * DA Form 2-1 (Personnel Qualification Record), dated 7 January 1981 * DD Form 214 (Certificate of Release from Active Duty), effective date 18 November 1977 * DD Form 214, (Certificate of Release or Discharge from Active Duty), dated 14 January 1982 4. The applicant provides a SSA card that does not list his SSN as " XXX-XX-XXXX." 5. The applicant's record is void of evidence that shows his SSN as " XXX-XX-XXXX." BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was not warranted. Based upon all records within the military service record reflecting the same SSN as that depicted on the applicant's DD Form 214, the Board found no injustice or correction needing to be made. The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. 2. A copy of this decisional document will be filed in the Applicant's official military personnel file. This should serve to clarify any questions or confusion about the difference in the social security number recorded in his military records and the social security number he currently uses. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), dated 23 May 1972, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
