Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to add any authorized awards. 2. She states all the medals and awards that she received, or was entitled to, are not listed on her DD Form 214. 3. She provides her DD Form 214 for the period ending on 12 April 2003. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 24 February 2000, the applicant enlisted in the U.S. Army Reserve (USAR) and she served in military occupational specialty 95B (Military Police). 3. She was ordered to active duty in support of Operation Enduring Freedom and entered active duty on 17 June 2002. 4. Permanent Orders (PO) 179-001, dated 28 June 2002, issued by Headquarters, U.S. Army, Fort Dix, NJ, show the applicant deployed as a member of the Headquarters, 377th Military Police Company. 5. She was honorably released from active duty on 12 April 2003. Her DD Form 214 shows the following entries: * Item 12f (Foreign Service), no foreign service listed * Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of her DD Form 214 shows she was awarded or authorized Army Reserve Components Achievement Medal, National Defense Service Medal, Armed Forces Reserve Medal with "M" Device, and Army Service Ribbon * Item 18 (Remarks), she served in Afghanistan from 1 September 2002 to 16 March 2003 (6 months and 16 days) 6. The applicant served in the USAR, and later in the Army National Guard, as a supply specialist. 7. She was honorably discharged from the USAR on 11 April 2008. REFERENCES: 1. Army Regulation (AR) 600-8-22 (Military Awards) states: a. The Afghanistan Campaign Medal is awarded to members who have served in direct support of Operation Enduring Freedom. The period of eligibility is on or after 11 September 2001 to 31 December 2014, and Operation Freedom Sentinel from January 15, 2015 to a future date to be determined by the Secretary of Defense or the cessation of Operation Enduring Freedom. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Her service coincides with the Consolidation I campaign (1 December 2001-30 September 2006). b. The Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the areas of eligibility designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 non-consecutive days are authorized the Global War on Terrorism Service Medal. 2. AR 635-5 (Personnel Separations-Separations Documents), in effect at the time, stated for Item 12f, to enter the total amount of foreign service completed during the period covered by the DD Form 214 and for item 13, to enter all awards and decorations. DISCUSSION: 1. The applicant served a qualifying period for award of the Global War on Terrorism Service Medal. This award is not listed on her DD Form 214. 2. She served in Afghanistan from 1 September 2002 to 16 March 2003. She served a qualifying period of service for award of the Afghanistan Campaign Medal. She also participated in one campaign, which authorizes her one bronze service star for wear on her Afghanistan Campaign Medal. This award is not listed on her DD Form 214. 3.
