Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show all awards to which he may be entitled. 2. The applicant states he was stationed in Korea (Camp Casey) from December 1966 to December 1967. He never received any of his medals or ribbons to which he may be entitled. He was also stationed at Camp George G. Meade from January to August 1968 and never received any awards at that time to which he may be entitled. He understands he was serving in the Army during the Vietnam War, which could explain why his DD Form 214 does not list all of his awards. The Soldiers who served in Korea during the Vietnam War did not receive all they may have been entitled to. He discovered the error at an Army reunion on 16 October 2016. 3. The applicant provides a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Regular Army on 4 August 1966. 3. His DA Form 20 (Enlisted Qualification Record) contains the following information: a. Item 31 (Overseas Service) shows he served in Korea from 23 December 1966 to 22 December 1967. b. Item 41 (Awards and Decorations) shows all the awards listed on his DD Form 214. 4. He was honorably released from active duty on 2 August 1968. His DD Form 214 shows he completed 1 year, 11 months, and 29 days of active service. His DD Form 214 also shows in: * Item 22c (Foreign And/Or Sea Service) – 1 year, 11 months, and 13 days and the entry Korea * Item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) – * National Defense Service Medal * Army Good Conduct Medal * Marksman Marksmanship Qualification Badge with Rifle Bar (M-14) 5. His record is void of any evidence indicating his entitlement to any additional awards for his period of active duty. REFERENCE: Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The regulation states the Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. DISCUSSION: 1. The applicant served a qualifying period for award of the Korea Defense Service Medal. His DD Form 214 does not list this award. 2.
