The applicant requests award of the Iraq Campaign Medal. 2. The applicant states when reviewing his DD Form 214 (Certificate of Release or Discharge from Active Duty) he discovered the Iraq Campaign Medal was omitted. He served in Kuwait/Iraq from 7 April 2003 to 2 February 2004. His DD Form 214 shows this service, but not the medal for the service. THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The regulation states: a. The Iraqi Campaign Medal is authorized for service in direct support of Operation Iraqi Freedom (OIF) from on or after 19 March 2003 to 31 December 2011 b. Bronze service stars are worn on campaign and service medals to denote participation in a named campaign. Campaign participation during the applicant's period of service included the Liberation of Iraq (19 March to 1 May 2003) and Transition of Iraq (2 May 2003 to 28 June 2004). c. The Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who participated in Global War on Terrorism operations outside of the areas of eligibility designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraqi Campaign Medal. All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined, having served 30 consecutive or 60 nonconsecutive days, are authorized the Global War on Terrorism Service Medal. DISCUSSION: 1. While the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Florida Army National Guard on 18 August 1997. He entered on active duty in support of OIF on 2 January 2002 and he held military occupational specialty 11B (Infantryman). 3. He served in Iraq/Kuwait from 7 April 2003 to 2 February 2004. 4. He was honorably released from active duty on 21 March 2004. His DD Form 214 shows he completed 1 year, 2 months, and 20 days of active service, which included 9 months and 26 days of foreign service. His DD Form 214 also shows he was awarded and authorized the: * Army Commendation Medal * Army Achievement Medal * Army Reserve Components Achievement Medal * National Defense Service Medal * Armed Forces Reserve Medal with "M" Device * Army Service Ribbon * Overseas Service Bar * Army Lapel Button * Sharpshooter Marksmanship Qualification Badge with Grenade Bar * Marksman Marksmanship Qualification Badge with Rifle Bar * Combat Infantryman Badge 5. The evidence show the applicant completed a qualifying period of service for award of the Iraq Campaign Medal with two bronze service stars. This award is not listed on his DD Form 214. 6. The applicant served on active duty in CONUS for 30 consecutive days prior to arriving in Iraq/Kuwait. This service meets the criteria for the Global War on Terrorism Service Medal.
