APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Orders T-12-510128 (Active Duty Orders) * DD Form 214, for the period ending 8 May 2016 FACTS: 1. The applicant states his DD Form 214 that was completed on 4 May 2016 for a period of active duty training (ADT) has the incorrect date he entered active duty. His orders show he started ADT on 10 January 2016 not 10 January 2015. The year 2015 on his DD Form 214 is incorrect and should be 2016. Due to the date being incorrect, his federal employer cannot backdate his thrift savings plan and retirement contributions he missed out on while he was on ADT and a correction would resolve this issue. 2. A review of the applicant’s service records show: a. He was appointed as a Reserve commissioned officer on 28 October 2015. b. He was ordered to ADT by Order T-12-510128, dated 10 December 2015, effective 10 January 2016 to attend a military course in Charlottesville, VA. c. He was released from ADT on 5 May 2016. His DD Form 214 shows in: * item 12a, 10 January 2015 * item 12c (Net Active Service This Period), 3 months and 26 days d. His DA Form 5016 (Chronological Statement of Retirement Points), which outlines his retirement point details shows from 28 October 2015 to 27 October 2016, he performed 122 days of active duty. 3. By regulation, the DD Form 214 is a summary of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty. It states request a DD Form 215 (Correction to DD Form 214) in the event errors are detected on the DD Form 214 after the Soldier’s separation date and for: * item 12a, data sources include an initial order to active duty; enter the beginning date of the continuous period of active duty for issuance of the DD Form 214 * item 12c, amount of service this period, computed by subtracting block 12a from 12b (Separation Date This Period) BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was warranted. The applicant’s contentions were carefully considered. Evidence of record shows he entered the period of active duty in 2016; however, the DD Form 214 shows he entered in 2015. The Board agreed an error is reflected on his DD Form 214. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending BLOCK 12a. on his DD Form 214 for the period ending 5 May 2016 by showing the entry “2016 01 10.” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Army Regulation (AR) 635-8 (Separation Processing and Documents), currently in effect, prescribes policy and procedural guidance relating to transition management. It consolidates the policies, principles of support, and standards of service regarding processing personnel for transition. It explains separation document preparation, distribution, correction, and transition processing. It states in: a. Paragraph 5-6 (Rules for Completing the DD Form 214) states for: (1) Item 12a (Date Entered Active Duty This Period), data sources are enlistment contract(s), initial order to active duty, active duty order, previously issued DD Forms 214, DA Form 1506 (Statement of Service – For Computation of Length of Service for Pay Purposes), and a complete review of the Soldier’s official record. Enter the beginning date of the continuous period of active duty for issuance of this DD Form 214, for which a DD Form 214 was not previously issued. Do not depend on basic active service date for this data item. The basic active service date can be an adjusted date. (2) Item 12b (Separation Date This Period), list the Soldier’s transition date. This date may not be the contractual date if the Soldier was separated early, voluntarily extends, is extended to make up lost time, or is retained on active duty for the convenience of the Government. (3) Item 12c (Net Action Service This Period), amount of service this period, computed by subtracting block 12a from 12b. Lost time under 10 U.S. Code 972 and noncreditable time after expiration of term of service, if any, are deducted. Lost time will be listed in block 29; other noncreditable time will be identified in block 18. If Soldier was releaed from active duty because of voided enlistment, enter “00 00 00.” b.
