Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the removal of an Army Good Conduct Medal (AGCM) disqualification memorandum, dated 8 July 2014, from his official military personnel file (OMPF). 2. The applicant states he was flagged while undergoing an investigation when the monthly reports came out. His unit disqualified him for the AGCM because of the flag. His case was closed favorably, the flag was removed, no action was taken, and his promotable status was reinstated. Since then, he was awarded the AGCM for that time period. 3. The applicant provides: * an AGCM disqualification memorandum, dated 8 July 2014 * DA Form 268 (Report to Suspend Favorable Personnel Actions (Flag)), dated 24 July 2014 * a memorandum for record, dated 11 September 2014, subject: Commander's Recommendation * Permanent Orders 287-30, issued by the 129th Combat Sustainment Support Battalion on 13 October 2016 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 13 August 2002. He is currently serving on active duty in the rank of staff sergeant. 2. The applicant's OMPF contains Permanent Orders 271-11, issued by the 21st Theater Sustainment Command on 28 September 2011, which awarded him the AGCM (3rd Award) for the period 13 August 2008 to 12 August 2011. 3. By memorandum dated 8 July 2014, the applicant's commander notified him that he was disapproved for the AGCM for the period 13 August 2011 to 12 August 2014, due to being flagged while under investigation. This disqualification memorandum is filed in the performance folder of his OMPF. 4. A DA Form 268, dated 24 July 2014, shows the applicant's case was closed favorably and the flag was removed effective 17 July 2014. 5. A memorandum for record, dated 11 September 2014, subject: Commander's Recommendation, issued by his immediate commander, confirms the applicant's case was closed favorably and the flag was removed effective 17 July 2014. The memorandum also shows the applicant's commander recommended his reintegration into the promotion system. 6. Permanent Orders Number 287-30, issued by the 129th Combat Sustainment Support Battalion on 13 October 2016, awarded the applicant the AGCM (4th Award) for the period 13 August 2011 to 12 August 2014. REFERENCES: Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes the policies governing the OMPF, the military personnel records jacket, the career management individual file, and Army personnel qualification records a. Paragraph 3-6 states that once a document is placed in the OMPF, it becomes a permanent part of that file and will not be removed from that file or moved to another part of the file unless directed by, among other agencies, the Army Board for Correction of Military Records. b. Table 3-1 states the performance folder of the OMPF contains performance related information to include evaluations, commendatory documents, specific disciplinary information, and training/education documents. The primary purpose of this folder is to provide necessary information to officials and selection boards tasked with assessing Soldiers for promotion, special programs, or tours of duty. This folder populates various board-related applications (for example, Army Selection Board System, National Guard Army Board System). DISCUSSION: 1. The performance folder of the applicant's OMPF includes an AGCM disqualification memorandum for the period 13 August 2011 to 12 August 2014. According to the applicant's immediate commander, the applicant's case was closed favorably and the flag was removed effective 17 July 2014. 2. The evidence shows the applicant was subsequently awarded the AGCM (4th Award) for the period in question. Therefore, the presence of the disqualification memorandum in his records renders his record inaccurate.
