IN THE CASE OF: BOARD DATE: January 14, 2020 DOCKET NUMBER: AR20170001724 APPLICANT REQUESTS: waiver of a $702.00 debt resulting from servicemembers’ group life insurance (SGLI). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record). FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he declined SGLI coverage 3. Review of the applicant’s service records shows: a. He enlisted in the U.S. Army Reserve on 2 November 2007. b. On 14 September 2008, he was transferred to Headquarters and Headquarters Company, XXth X__ X__ Command, Fort X___, XX. c. He entered active duty on 9 November 2009; however, he was honorably release from active duty some 5 months and 6 days later on 15 April 2010. d. On release from active duty, he was transferred back to the 468th Chemical Battalion, Little Rock, AR. e. No other documents (assignment, reassignment, discharge, separation, etc) exist in his file beyond his release from active duty 4. The Army G-1 reviewed his case and rendered an advisory opinion on 25 November 2019. The Army G-1 advisory official stated the applicant asks for relief of a $702 debt for SGLI premiums based upon the claim that he had declined coverage. He states he is unsure of the date he declined coverage and provided no evidence to support his claim. Since the applicant is living, Casualty and Mortuary Affairs Operations Division cannot ask Prudential Insurance for a reimbursement on his behalf. This debt must be paid or debt relief must be negotiated by him and Prudential Insurance, Office of Servicemembers' Group Life Insurance. 5. The applicant was provided with a copy of this advisory opinion to give him an opportunity to submit a rebuttal. He did not respond. 6. SGLI is a program that provides low-cost term life insurance coverage to eligible members of the uniformed services. SGLI is a group life insurance policy purchased by the Department of Veterans Affairs (VA) from a commercial life insurance company. (Prudential). SGLI coverage is available in $50,000 increments up to the maximum amount of $400,000. Servicemembers are automatically insured for the maximum coverage amount of $400,000 unless they decline coverage or elect a reduced amount. If eligible, service members are automatically issued the maximum SGLI coverage. Servicemembers can make changes to your SGLI coverage. For example, Servicemembers can decline SGLI coverage, select a lesser amount than maximum coverage, designate beneficiaries, and/or make other changes. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The Board determined that if the applicant could provide corroborating evidence to support his statement that coverage was declined, the Board would reconsider. However, based upon the current available documentary evidence, the Board found that insufficient evidence was available to show that there was an error or injustice which would warrant a correction to the record.
