The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20120005044 on 20 September 2012. 3. The applicant states, in effect, he requested his SSN to be corrected prior to his discharge from military service and the request was denied. He requested again in 2011, however, he now realizes he submitted the request incorrectly. He contends his SSN was listed incorrectly on his DD Form 214. He request his SSN to read as "XXX-XX-XXXX" instead of "XXX-XX-XXXX." 4. On 14 November 1983, the applicant enlisted into the Regular Army. He was released from active duty on 7 October 1986. All of the records and documents in his military record show his SSN listed as "XXX-XX-XXXX." These documents include but are not limited to the following records: * DD Form 1584 (National Agency Check request), dated 10 November 1983 * DD Form 4 (Enlistment or Reenlistment Agreement – Armed Forces of the United States), dated 14 November 1983 * DA Form 2-1 (Personnel Qualification Record), dated 6 May 1986 * DD Form 93 (Record of Emergency Data), dated 6 May 1986 * 18 November 1977 * DD Form 214, (Certificate of Release or Discharge from Active Duty), dated 7 October 1986 5. The applicant provides a Social Security card and a beneficiary statement that list his SSN as "XXX-XX-XXXX." 6. The applicant's record is void of evidence that shows his SSN as "XXX-XX-XXXX." BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was not warranted. Based upon all military records within the military service record reflecting the same SSN as that depicted on the DD Form 214 of the applicant, the Board found no injustice that required a correction to the applicant’s 214. The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis to amend decision of the ABCMR set forth in Docket Number AR20120005044, dated 20 September 2012. 2. A copy of this decisional document will be filed in the Applicant's official military personnel file. This should serve to clarify any questions or confusion about the difference in the social security number recorded in his military records and the social security number he currently uses. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
