THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the following documents be removed from his official military personnel file (OMPF): * Orders 130-304, issued by Detachment A, 203rd Personnel Services Battalion on 10 May 2005 * Permanent Order APOP 6-8, issued by Headquarters, U.S. Army Pacific on 22 June 2005 * Valorous Unit Award (VUA) Certificate, issued to 4th battalion, 23rd Infantry Regiment for the period 16 August 2005 to 3 December 2006 * Department of the Army General Orders (DAGO) Number 2010-22, awarding the Presidential Unit Citation (PUC) * Permanent Order 198-02, issued by U.S. Army Human Resources Command (HRC) on 17 July 2014, awarding the Meritorious Unit Commendation (MUC) * HRC memorandum, SUBJECT: MUC, dated 10 February 2015 2. The applicant states the erroneous documents have recently been uploaded into his OMPF. Even though his social security number (SSN) is clearly annotated in the top right corner on some of the documents, he has not, at any point of his career, had any affiliation with the awards and decorations nor other activities reflected by those documents. He is not sure what caused this error; possibly clerical error by the uploader. He has made attempts to correct his record. 3. The applicant provides a copy of his enlisted records brief (ERB), dated 23 January 2017, to support his request. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 7 July 2005. He is currently serving in the Regular Army as a staff sergeant (SSG). 2. Orders 130-304, issued by Detachment A, 203rd Personnel Services Battalion on 10 May 2005, shows 4th Battalion, 23rd Infantry Regiment received temporary change of station (TCS) orders for deployment to Iraq. The applicant's SSN is reflected at the top right corner of the order; however, he had not yet entered the Army at that time. 3. Permanent Order APOP 6-8, issued by Headquarters, U.S. Army Pacific on 22 June 2005, amended Permanent Order APRM 6-2, issued by Headquarters, U.S. Army Pacific on 11 June 2003. The applicant's SSN is reflected at the top right corner of the order; however, he had not yet entered the Army at that time. 4. A VUA Certificate, issued to 4th battalion, 23rd Infantry Regiment for extraordinary heroism in military operations against an armed enemy for the period 16 August 2005 to 3 December 2006, shows the applicant's SSN at the top right corner of the certificate. However, he attended initial entry training from on or about 7 July 2005 through on or about 7 December 2005, and was later assigned to Headquarters and Headquarters Company, Armored Regiment, Camp Casey, Republic of Korea from on or about 8 December 2005 through on or about 3 December 2006. 5. DAGO Number 2010-22, issued by Headquarters, Department of the Army, on 24 November 2010, announced award of the PUC to various units and their attached units, for extraordinary heroism from 19 march 2003 to 1 May 2003. The applicant's SSN is reflected at the top right corner of the order; however, he had not yet entered the Army at that time. 6. Permanent Order 198-02, issued by HRC on 17 July 2014, announced award of the MUC to Headquarters and Headquarters Troop, 2nd Calvary Regiment and cited units for meritorious service while deployed to Afghanistan from 18 June 2013 to 11 April 2014. The applicant's SSN is reflected at the top right corner of the order. However, he was assigned to the 676th Acquisition Support Detachment, Joint Base Lewis-McCord (JBLM), WA at that time. In addition, his record confirms he did not deploy to Afghanistan at any time during his period of service. 7. A HRC memorandum, SUBJECT: MUC, dated 10 February 2015, announced recommendation for award of the MUC to Headquarters and Headquarters Troop, 2nd Calvary Regiment and cited units for the period 18 June 2013 to 11 April 2014 was approved. The applicant's SSN is reflected on the top right corner of the memorandum; however, he was not assigned to that unit at that time. REFERENCES: 1. Army Regulation 670-1 (Wear and Appearance of Army Uniforms and Insignia) states unit awards are authorized for permanent wear by an individual who was assigned and present for duty with the unit at any time during the period cited or who was attached to and present for duty with the unit for at least 30 consecutive days of the period cited. 2. Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes the Army policy for the creation, utilization, administration, maintenance, and disposition of the Army Military Human Resource Record (AMHRR) which includes, but is not limited to, the OMPF. Paragraph 3-6 of this regulation states that once a document is filed in the AMHRR, the document will not be removed from the record unless directed by proper authorities listed in the regulation such as the ABCMR. Table 3-1 (OMPF folders in the AMHRR) of this regulation shows that commendatory items are to be filed in the performance section of the OMPF. DISCUSSION: The evidence of record shows that the applicant's SSN is at the top right corner of the contested orders for the PUC, MUC, TCS, amendment to the TCS, MUC memorandum and VUA certificate filed in his OMPF. However, the evidence of record clearly shows he was never assigned to the units in question.
