The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his records were not updated by his unit admin. 3. A review of his service record shows: a. The applicant enlisted in the New York Army National Guard on 7 December 2007. b. His 28 February 2013 DD Form 214 shows the following entry: item 14 – COMPTIA NETWORK Plus, 2 weeks, 2012//Nothing Follows. c. His NGB 22 dated 6 December 2013 shows the following entries: item 12 – * Warrior Trans Course 6 weeks, 2008 * Info Sys Operator & Analyst Course, 19 weeks, 2009 * WLC 2 weeks, 2011 * CLS Course, 1 week, 2012 * CompTIA Network Plus Course, 2 weeks, 2012 d. His NGB 22A dated 8 September 2016 corrects the following item numbers: * Item 12 – add Basic IT Networking Course 1 week, 2011 * Item 12 – add GBS Operator & Maintainer Course 1 week, 2012 * Item 12 – add Battalion Command Post Node Course 2 weeks, 2011 * Item 12 – add Security Plus Course 1 week, 2012 4. Army Regulation 635-5 (Separation Documents), in effect at the time, established standardized policy for preparing and distributing the DD Form 214. It stated the DD Form 214 was a summary of the Soldier's most recent period continuous active duty. 5. The instructions stated for: item 14, list formal in-service, full-time attendance training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and years completed. Do not list training courses for combat skills. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was not warranted. The applicant’s contentions were carefully considered. The evidence of record shows the courses were not completed during the period covered by the DD Form 214. Based upon regulatory guidance, the Board agreed there was no error or injustice in this case. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. The regulation states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty.
