ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 25 September 2019 DOCKET NUMBER: AR20170002864 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty), to reflect that he only served 3 years in a recruiter capacity. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that the DD Form 214 he received when he retired shows in block 11, that he was a recruiter/RET NCO for 12 years. It is incorrect because he only served 3 years as a recruiter, from 1984 to 1987. 3. A review of the applicant’s service records shows the following: a. He enlisted in the Regular Army (RA) on 6 October 1972. He served in Germany from 26 March 1973 to 25 September 1975. b. He was honorably relieved from active duty on 1 October 1975, under the provisions of Army Regulation (AR) 635-200, chapter 5-14 (Short length of time remaining on active duty precludes reassignment). c. He enlisted in the RA on 9 October 1979. d. His DA Form 2-1 (Personnel Qualification Record) reflects that he served as a: * Recruiter effective 6 July 1984 * Field Recruiter effective 1 October 1985 * Station Commander effective 1 July 1986 * Station Commander effective 1 July 1987 e. His Enlisted Evaluation Report (EER), dated 06/84 reflects that he served as Assistant Noncommissioned Officer in Charge of In/Out Processing. f. His EER dated 09/85, reflects his first evaluation in the Field Recruiter position for 12 months. His EER dated 09/87, reflects his last evaluation in a recruiter capacity for 3 rated months. g. His EER dated 05/88, reflects he served as a Records Team Chief. h. He was honorably retired on 31 October 1996, under the provisions AR 635-200, chapter 12 (Sufficient Service for Retirement). His DD Form 214 reflects in item 11 (Primary Specialty): * 75Z40 00 Personnel Sergeant- - 6 years, 8 months * 31U4L 00 Wire Installer - 2 years, 6 months * 75D40 Record Specialist - 4 years, 3 months * 00R40 Recruiter RTN NCO - 12 years, 4 months 4. By regulation, AR 635-5, item 11 (Primary Specialty), is recorded from the Enlisted Records Brief (ERB), enter the titles of all MOS or Area of Concentration (AOC) served for at least 1 year and include for each MOS/AOC the number of years and months served. For time determination, 16 days or more count as a month. 5. By regulation AR 601-1, detailed recruiters will be established in U.S. Army Recruiting Command (USAREC) for 36 months. Recruiters must serve a minimum of 24 months in a geographical location before any cost reassignment is authorized. Normal and maximum tour lengths for career recruiting personnel are established for Sergeant first class (P) and below. Normal tour in the same recruiting battalion, brigade, or in HQ USAREC is 4 years; maximum time in the same unit is 6 years. SFC (P) and below are eligible to be moved between the 2d and 6th year based on the needs of the command BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was warranted. The applicant’s contentions were carefully considered. Evidence of record shows he was assigned as a detailed Recruiter for 3 years; however, his DD Form 214 erroneously shows 12 years, which warrants a correction to the applicant’s record. The Board agreed to correct his separation document. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending block 11 of his DD Form 214 for the period ending 31 October 1996 by showing “00R40 RECRUITER RTN NCO --3 YRS MOS.” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 601-1 (Personnel Procurement - Assignment of Enlisted Personnel to the U.S. Army Recruiting Command), sets policies and procedures for the selection, assignment, and reassignment of enlisted personnel assigned to recruiting and administrative support positions in the U.S. Army Recruiting Command (USAREC), subordinate recruiting brigades, recruiting battalions, USAREC, and Fort Benjamin Harrison, Indiana as instructors for the Army Recruiter Course or in recruiting-related courses. 3. AR 635-5 (Personnel Separations - Separation Documents), prescribes the separation documents that must be prepared for soldiers on retirement, discharge, release from active duty service, or control of the Active Army.
