ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 17 April 2019 DOCKET NUMBER: AR20170003016 APPLICANT REQUESTS: Correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) with an effective date of 10 February 1988 to show: * his service in Grenada * Armed Forces Service Medal (AFSM) * Unspecified campaign medal APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record). FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: * his record does not show his service in Grenada in support of the 18th Airborne Corps as a Communications Repairman for operation Urgent Fury * he was deployed to Grenada about 7 days after the start date of the conflict and he worked at a hotel above the air strip * the record should show the AFSM and a campaign medal * these corrections to his record are important because this would be his proof of protected veteran status for employment applications * he has worked his current job for 22 years but he did not knew about protected veteran status and therefore, he never realized it was missing from his record * his November and December 1983 pay stubs will reflect he received combat pay for service in Grenada 3. The applicant enlisted in the Regular Army on 11 February 1983. 4. His DA Form 2-1 (Personnel Qualification Record – Part II) does not show he was deployed to Grenada in support of Operation Urgent Fury. This form also does not list award of the AFSM or any campaign medals. The form does show he was assigned to Company C, 25th Signal Battalion, Fort Bragg, NC (home station of the 18th Airborne Corps), as a field communications security equipment repairer from 2 August 1983 to 6 January 1985 (see item 35). 5. On 10 February 1988, he was released from active duty and transferred to the U.S. Army Reserve Control Group (Reinforcement). His DD Form 214 does not show the AFSM or a campaign medal as authorized awards. 6. His service record is void of temporary duty orders, military pay records or other evidence that indicate he deployed with the 18th Airborne Corps in support of military operations in Grenada. 7. Army Regulation 600-8-22 (Military Awards) states the AFSM may be awarded to members of the Armed Forces of the United States for operations for which no other U.S. campaign or service medal is approved and who, after 1 June 1992, participate or have participated as members of U.S. military units in a U.S. military operation deemed to be a significant activity and encounter no foreign armed opposition or imminent threat of hostile action. The AFSM was authorized subsequent to the applicant's separation from the service. 8. Army Regulation 600-8-22 states the Armed Forces Expeditionary Medal is awarded for qualifying service for participation in Operation Urgent Fury in Grenada during the period 23 October 1983 through 21 November 1983. Qualifying service for non-unit direct support personnel in Grenada is 6 consecutive days or 12 non-consecutive days. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was not warranted. Based upon the documentary evidence presented by the applicant and found within the military service record, the Board found insufficient evidence to show that the applicant had any service in Grenada or that he was awared or eligible for being awarded the Armed Forces Service Medal (AFSM). For that reason, the Board recommended denying the applicant’s request for relief. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 states the AFSM may be awarded to members of the Armed Forces of the United States for operations for which no other U.S. campaign or service medal is approved and who, after 1 June 1992, participate or have participated as members of U.S. military units in a U.S. military operation deemed to be a significant activity and encounter no foreign armed opposition or imminent threat of hostile action. 3. Army Regulation 600-8-22 states the Armed Forces Expeditionary Medal is awarded for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in Operation Urgent Fury in Grenada during the period 23 October 1983 through 21 November 1983.
