APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: •DD Form 149 (Application for Correction of Military Record) •Self-authored letter, dated 26 December 2016 •DD Form 214, for the period ending 20 October 2003 •Orders 046-718, dated 15 February 2003 •Deployment Roster, dated 18 February 2003 •Memorandum, subject: Request for Personnel Departure from Theater ofOperations, dated 24 June 2003 •Memorandum, subject: In Theater Deployment Cycle System (DCS) Validation,dated 24 June 2003 •Memorandum, subject: Request for Early Departure from Theater for (Applicant),dated 24 June 2003 •Letter from Awards and Decorations Branch, Army Human Resources Command(HRC), dated 5 November 2012 FACTS: 1.The applicant did not file within the three year time frame provided in Title 10, UnitedStates Code (USC), section 1552 (b); however, the Army Board for Correction ofMilitary Records conducted a substantive review of this case and determined it is in theinterest of justice to excuse the applicant's failure to timely file. 2.The applicant's DD Form 214 for the period 8 September 2000 through 20 October2003 contains the following information: a.Item 13 (Decorations, Medals, Badges, Citations and Campaign RibbonsAwarded or Authorized), shows no entries awarding him the Iraq Campaign Medal or Global War on Terrorism Service Medal. b.Item 12f (Foreign Service), shows the entry, "0000 00 00." c.Item 18 (Remarks), no recorded entry that indicate he participated in any namedoperations or campaigns (i.e. Iraq). 3.A review of his record contains a DD Form 215 (Correction to DD Form 214), dated6 November 2012 and issued by HRC, correcting item 13 of his DD Form 214 by addingthe following: •Army Achievement Medal with One Bronze Oak Leaf Cluster •Iraq Campaign Medal with two Bronze Service Stars •Global War on Terrorism Service Medal 4.Defense Finance and Accounting Service (DFAS) records show the applicantreceived hostile fire/imminent danger pay (HF/IDP) and combat zone tax exclusion(CZTE) for service in Kuwait/Iraq from 1 March 2003 through 31 July 2003, a period of153 days or 5 months. 5.The applicant provides: a.Orders 046-718, dated 15 February 2003 with an excerpt of a deployment rostershowing he was deployed with his unit in support of Operation Enduring Freedom (i.e. Iraq). b.Three memoranda, dated 24 June 2003 authorizing the applicant to depart Iraqand return to the continental United States due to a needed medical procedure. c.A letter from Awards and Decorations Branch, HRC authorizing his entitlement toawards and decorations as a result of his service in Iraq and addressing his contention that his service time in Iraq needed to be addressed by this Board. 6.The applicant's service in the Republic of Iraq is not shown in item 12f or item 18 ofhis DD Form 214 nor corrected on his DD Form 215 as prescribed within ArmyRegulation 635-5 (Separation Documents), dated 15 September 2000. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was warranted. Based upon the documentary evidence presented and found within the military service record, the foreign service to Iraq was not annotated on his DD Form 214 or DD Form 215; therefore, the Board recommended granting the applicant’s request for relief. REFERENCES: 1.Title 10, USC, section 1552(b), provides that applications for correction of militaryrecords must be filed within three years after discovery of the alleged error or injustice.This provision of law also allows the Army Board for Correction of Military Records(ABCMR) to excuse an applicant's failure to timely file within the three-year statute oflimitations if the ABCMR determines it would be in the interest of justice to do so. 2.Army Regulation 635-5 (Separation Documents), dated 15 September 2000,prescribes the separation documents prepared for Soldiers upon retirement, discharge,or release from active military service or control of the Army. It establishesstandardized policy for preparation of the DD Form 214. It states the DD Form 214 is asynopsis of the Soldier's most recent period of continuous active service. It provides abrief, clear-cut record of active Army service at the time of release from active duty,retirement, or discharge. It is important that information entered on the form is completeand accurate. Chapter 2 contains specific guidance for preparation of theDD Form 214. It states for: a.Item 12f (Foreign Service), enter the total amount of foreign service completedduring the period covered by the DD Form 214. b.Item 18 (Remarks), for an active duty Soldier deployed with his or her unit duringtheir continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYMMDD)."
