ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 13 May 2019 DOCKET NUMBER: AR20170003271 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to upgrade his reentry (RE) code from RE-3 to RE-1. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 293 (Application for the Review of Discharge from the Armed Forces of the United States) * DD Form 214 FACTS: 1. The applicant states he would like his RE-3 be changed to RE-1. He served his country honorably and deserves to reenter the service if he desires to. He was discharged due to reaching his retention control point (RCP) in time in grade/service. He was a good Soldier and does believe he deserves a RE-3. 2. A review of the applicant’s service records shows: a. He enlisted in the Regular Army on 23 November 2010. b. His Enlisted Record Brief (ERB) shows he was promoted to specialist/E-4 on 1 November 2012 but was reduced to private first class/E-3 on 31 March 2016. c. He was honorably released from active duty on 1 October 2016. His DD Form 214 shows he completed 5 years, 10 months, and 9 days of active service. It also shows in: * items 4a (Grade, Rate or Rank) and 4b (Pay Grade) the entries PFC and E-3 * item 12i (Effective Date of Pay Grade), 2016-03-31 * tem 25 (Separation Authority), Army Regulation 635-200 (Active Duty Enlisted Administrative Separations), chapter 4 * item 26 (Separation Code), MBK * item 27 (RE Code), 3 * item 28 (Narrative Reason for Separation), Completion of Required Service 3. By regulation (AR 601-280), Soldiers may perform service on active duty (provided they are not barred from continued service or otherwise separated) up to their Retention Control Point (RCP) or age 60, whichever occurs first. For the rank/grade of PFC/E-3, the maximum years of active service is 5. 4. By regulation, separation code MBK is appropriate when the narrative reason for separation is completion of required active service and the authority for discharge is AR 635-200, chapter 4. The corresponding RE code associated with this separation is RE-1 or RE-3. 5. By regulation, RE-3 applies to persons who are not considered fully qualified for RE or continuous service at the time of separation, but disqualification is waivable. A member who desires to reenter military service should contact a local recruiter who can best advise her/him on her/his eligibility for returning to military service. Those individuals can best advise a former service member as to the needs of the service at the time and may process enlistment waivers for the applicant's RE code. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was not warranted. Based upon the regulatory guidance found in AR 601-280 and the circumstances which led to the applicant’s administrative separation, the Board found no error or injustice with the reentry code which would warrant making a correction to the record. Army Regulation (AR) 635-200 (Active Duty Enlisted Administrative Separations), in effect at the time, sets forth the basic authority for the separation of enlisted personnel. Chapter 4 of that regulation states a Soldier will be separated upon expiration of enlistment or fulfillment of service obligation. 2. AR 601-280 (Army Retention Program) sets forth policy and procedures for reenlistments. It also lists the Retention Control point for each rank/grade. The regulation in effect at the time stated that an E-3 could service a maximum of 5 active service years. 3. AR 601-210 (Active and Reserve Components Enlistment Program), in effect at the time, covers eligibility criteria, policies, and procedures for enlistment and processing. Table 3-1 lists the reentry (RE) eligibility codes. a. RE-1 applies to persons completing their term of active service who is considered qualified to reenter the Army; qualified for enlistment if all other criteria are met. b. RE-3 applies to persons who are not considered fully qualified for RE or continuous service at the time of separation, but disqualification is waivable; ineligible unless a waiver is granted. 4. AR 635-5-1 (Personnel Separations – Separation Program Designator (SPD), shows that the separation program designator “MBK” specifies the narrative reason for discharge as “Completion of Active Duty Service”. The authority for discharge under this separation program designator is AR 635-200, Chapter 4. 5. The Separation Program Designator (SPD)/RE Code Cross Reference Table, dated 15 June 2006, shows Soldiers assigned an SPD code of MBK will be assigned an RE code of 1 or 3.
