Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of the prior denial for the award of the Korean Service Medal. 2. The applicant states he served at Camp Sendai in support of the war effort from May 1953 through November 1954 during the "Korean Summer of 1953" war campaign. In his previous attempts to get this medal awarded it was stated that XVl Corps was not listed as a unit having supported the military effort in Korea by the Department of the Army General Orders Number 39, dated 9 June 1955. He believes this is because the XVI Corps was deactivated on 20 November 1954 and became the IX Corps. He believes this is why they are not listed as supporting the war effort. 3. The applicant provides copies of: * his DD From 214 (Armed Forces of the United States Report of Transfer or Discharge) [as amended] * DA Form 1 showing his detachment from Headquarters XVI Corps * one page of a magazine article referencing the Korean Service Medal * 2 page internet printout of the XVI Corps' service CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR2003086963 on 28 August 2003. 2. The submission of the applicant's DA Form 1, DD Form 214, magazine article have been previously submitted and as such are not new evidence. His comments are only slightly different in reference to the location of assignment. 3. The applicant served on active duty from 12 December 1952 through 19 November 1954 with assignment with the Military Police Platoon, Headquarters, XVI Corps at Camp Sendai, Japan. 4. The internet printout does not include any reference to the applicant's unit. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states the Korean Service Medal is awarded for service between 27 June 1950 and 27 July 1954, under any of the following conditions: a. Within the territorial limits of Korea or in waters immediately adjacent thereto. b. With a unit under the operational control of the Commander in Chief, Far East, other than one within the territorial limits of Korea, which has been designated by the Commander in Chief, Far East, as having directly supported the military efforts in Korea. c. Was furnished an individual certificate by the Commander in Chief, Far East, testifying to material contribution made in direct support of the military efforts in Korea. 2. A review of the official Army unit history records for the XVI Corps shows it was originally activated in 1943 and deactivated on 7 December 1945. It was reactivated in April 1951 as the Far East Command Reserve. Following its reactivation in May 1951, XVI Corps was headquartered at Sendai, Japan, until it was inactivated there on 20 November 1954. The corps mission was to control divisions and other units attached to it by Far East Command. 3. Army Regulation 15–185 (Army Board for Correction of Military Records) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the Army Board for Correction of Military Records (ABCMR). It states the ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. It also states when the ABCMR receives the request for reconsideration if the ABCMR has not previously reconsidered the matter, it will be reviewed to determine if it contains evidence (including, but not limited to, any facts or arguments as to why relief should be granted) that was not in the record at the time of the ABCMR’s prior consideration. If new evidence has been submitted, the request will be submitted to the ABCMR for its determination of whether the new evidence is sufficient to demonstrate material error or injustice.
