Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show all awards she is entitled. 2. The applicant states her DD Form 214 does not reflect the Army Commendation Medal (ARCOM) which was awarded to her on 14 January 1999. 3. The applicant provides: * DD Form 214 * DA Form 4980-14 (ARCOM certificate) * DA Form 638 (Recommendation for Award) CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 18 August 1994. 3. Evidence shows she successfully completed the Primary Leadership Development Course (PLDC) at the Eighth U.S. Army (EUSA) Wrightman Noncommissioned Officer (NCO) Academy during the period 23 July to 21 August 1997 (a period of 4 weeks). 4. The applicant's DA Form 2-1 (Personnel Qualification Record) shows she served in Korea for the period 28 January 1997 to 2 April 1999. 5. The applicant was honorably released from active duty on 2 April 1999 in the rank/grade of sergeant/E-5. She completed 4 years, 7 months and 15 days net active service during this period. Item 12f (Foreign Service) shows she completed 2 years, 2 months and 5 days of foreign service. Her DD Form 214 shows she was awarded or authorized the: * Army Good Conduct Medal * National Defense Service Medal * Army Service Ribbon * Overseas Service Ribbon * Marksman Marksmanship Qualification Badge with Rifle Bar (M-16) 6. The applicant provides and her records contain Permanent Order Number 14-4 issued by the commander, 501st Military Intelligence Brigade which awarded her the ARCOM on 14 January 1999. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards), states: a. The ARCOM may be awarded to any member of the Armed Forces of the United States who, while serving in any capacity with the Army after 6 December 1941, distinguishes himself or herself by heroism, meritorious achievement, or meritorious service. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. b. The Korea Defense Service Medal (KDSM) was established by the National Defense Authorization Act of 2003, Public Law 107-314. It is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. The criteria for this award is a Soldier must have been assigned, attached or mobilized to units operating in the area of eligibility for 30 consecutive days or for 60 nonconsecutive days. c. The NCO Professional Development Ribbon (NPDR) is awarded to Active Army, Army National Guard, and U.S. Army Reserve Soldiers for successful completion of designated NCO professional development courses. 2. Army Regulation 635-5 (Separation Documents), then in effect, prescribes the separation documents that must be prepared for Soldiers upon retirement, discharge, release from active duty service, or control of the Active Army. It also establishes standardized policy for preparing and distributing the DD Form 214. Chapter 2 contains item-by-item instructions for preparation of the DD Form 214. It states for item 14 (Military Education), list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. DISCUSSION: 1. Permanent orders awarded the applicant the ARCOM, which is not listed on her DD Form 214. 2. Evidence show the applicant served in Korea for the requisite amount of time to receive the KDSM, which is not listed on her DD Form 214. 3. Evidence shows the applicant successfully completed the PLDC at the EUSA Wrightman NCO Academy during the period 23 July through 21 August 1997, which equates to 4 weeks of training. Therefore, her DD Form 214 should be corrected to show this military education. 4.
