The applicant states DA Form 4187 dated 2 October 2014 should be removed from her official military personnel file (OMPF). DA Form 4187 dated 18 October 2014 shows her correct date of rank promoting her to SPC/E4 effective 20 October 2014. 2. The applicant provides: a. DA Form 4187 (Promotion to SPC/E4) signed by Lieutenant Colonel (LTC) RMS. b. DA Form 4187 (Promotion to SPC/E4) signed by LTC RMS. 3. A review of the applicant’s service record shows: a. She enlisted in the United States Army Reserves (USAR) on 6 June 2011. She reenlisted on 6 April 2019 for 6 years. b. Her Army Military Human Resource Record in the Interactive Personnel Electronic Records Management System (iPERMS) contains the two DA Form 4187s in subparagraphs 2 a and b above. * DA Form 4187 signed on 2 October 2014 has a SPC/E4 date of rank (DOR) and effective of 31 October 2014 * DA Form 4187 signed on 18 October 2014 has a SPC/E4 DOR and effective date of 20 October 2014 c. Orders R-06-586935 dated 17 June 2015, Active Guard Reserve show her SPC/E4 DOR as 20 October 2014. d. The applicant’s automated record brief shows her SPC/E4 DOR as 20 October 2014 and current rank as sergeant. 4. By regulation, Army Regulation 600-8-19 (Enlisted Promotions and Reductions), the automated enlisted advancement report (Active Army) or, for USAR, DA Form 4187 or automated personnel system Army Reserve Advancement Eligibility Status Roster are the official instruments used by commanders to recommend Soldiers for promotion to SPC and below. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is sufficient evidence to grant relief. The applicant’s contentions were carefully considered. Her record shows two promotions actions to the rank of SPC, signed by the same promotion authority. However, each action shows a different effective date and date of rank for the same promotion month. The Board agreed to remove the DA Form 4187, dated 2 October 2014. Army Regulation 600-8-19 (Enlisted Promotions and Reductions), in effect at the time, sets forth the basic authority for the decentralized promotion system for promotions to SPC and below. a. Paragraph 1-13a, the Date of Rank (DOR) for promotion to a higher grade is the date specified in the promotion instrument or, when no date is specified, is the date of the instrument of promotion. b. Paragraph 2-3b, promotions to Private E2 (PV2), Private First Class (PFC), and Specialist (SPC) will be made automatically by the total Army personnel data base for posting to the automated personnel file and the master military pay file. Army National Guard (ARNG) and United States Army Reserve (USAR) Soldiers on initial active duty training (IADT) will not be promoted to SPC unless concurrence is obtained from the Soldier’s reserve component unit. DA Form 4187 will be used for all USAR Soldiers and all Army National Guard United States (ARNGUS) Soldiers awaiting initial entry training (IET) (special advancements and split training option-phase II) and all advancements for Soldiers in a Title 10 status (including mobilization). DA Form 4187 will not be used for automatic advancements. c. Paragraph 2-3c, eligibility criteria for automatic promotion to PV2, PFC, and SPC will be as follows: (1) The promotion to PV2 requirement is six months time in service (TIS). (2) The promotion to PFC requirements are 12 months TIS and 4 months time in grade (TIMIG). (3) The promotion to SPC requirements are 24 months TIS and 6 months TIMIG. d. Paragraph 2-3d, Soldiers promoted prior to or after the automatic promotion date require a DA Form 4187 and submission of a grade change transaction to be promoted. (1) DA Form 4187 is prepared prior to the Soldier’s eligibility date to ensure entitlements are received on time. (2) Effective date and DOR are the same unless stated otherwise in this regulation. For Soldiers promoted late, procedures in paragraph 1–13, of this regulation, will be used. (3) A human resource (HR) specialist or the unit commander signs each DA Form 4187 executing promotions to PV2, PFC, and SPC. e. Disposition of DA Form 4187. (1) Each DA Form 4187 will be annotated by name on unit transmittal memorandum (UTM) and forwarded to the promotion work center by UTM with the unit advancement report. (2) A copy in the battalion HR files will be filed along with a copy of the unit advancement report. (3) A copy will be filed in the local file and/or in the Soldiers military personnel file (MPF) and, as applicable, with the State Adjutant General.
