The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that he served in Bosnia from 21 March 1997 to 12 October 1997. 3. The applicant entered on active duty on 4 June 1994 and he served as a commissioned officer in the Regular Army, retiring on 31 October 2016. 4. The DD Form 214 he received upon retirement shows that he served in Bosnia on two occasions from: * 28 December 1995 to 15 May 1996 * 31 March 1997 to 20 July 1997 5. The applicant provides his Temporary Change of Station orders, an award recommendation and two OERs which show he served in Bosnia from on or about 12 November 1997 to on or about 21 October 1997. 6. DFAS pay records show he completed his second tour of duty in Bosnia from 1 March 1997 through 31 October 1997. 7. The ending date recorded on his DD Form 214 is different from the ending date recorded in his DFAS pay records. Deployment dates are required to be listed on the DD Form 214 in item 18. BOARD DISCUSSION: After reviewing the application and all supporting evidence, the Board found that full relief was warranted. There is substantial evidence that the applicant served in Bosnia beginning on 21 March 1997 and the applicant received an award recommendation for deployment through 21 October 1997. Therefore, the Board recommended full relief to the applicant for the dates 21 March 1997 to 21 October 1997. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. Chapter 2 contains guidance on the preparation of the DD Form 214.
