Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal from his official military personnel file (OMPF) of Permanent Orders (PO) 6-30 issued by Headquarters, U.S. Army John F. Kennedy Special Warfare Center and School, Fort Bragg, NC, on 6 February 2006, that awarded him the Military Free Fall Parachutist Badge. 2. The applicant states, in effect: a. He did not graduate from the Military Free Fall Parachutist Course in 2006. PO 6-30 was generated prior to graduation and erroneously filed in his military record. He graduated from the course in December 2008 with a graduation certificate and PO 337-49 awarding him the Military Free Fall Parachutist Badge, which is filed correctly in his military record. b. He submitted an email to Human Resources Command (HRC) requesting removal of PO 6-30 from his record. HRC stated that they needed a revocation order from the school to remove the PO. The school student records section contacted HRC regarding the issue and stated if a revocation order was submitted it would not remove the PO from his file. The revocation order would be placed in conjunction with PO 6-30. He further states that this would make anyone reviewing his file assume that his Military Free Fall Parachutist Badge was revoked due to something derogatory. c. PO 6-30 should have never been filed in his record, because he did not graduate the course at that time. He is not at fault. It is his understanding that a revocation order would not remove PO 6-30 from his records, and would only be filed in conjunction with the order, creating more issues, concerns, and questions. 3. The applicant provides: * PO 6-30, dated 6 February 2006 * PO 337-49, dated 2 December 2008 * Military Free Fall Parachutist Badge diploma * HRC email * Email requesting correction * Interactive Personnel Electronic Records Management System (IPERMS) correction request CONSIDERATION OF EVIDENCE: 1. The applicant is a Regular Army warrant officer serving in the rank/grade of chief warrant officer three (CW3/W-3). 2. PO 6-30, issued by U.S. Army John F. Kennedy Special Warfare Center and School, Fort Bragg, NC on 6 February 2006, awarded him the Military Free Fall Parachutist Badge. This order is filed in his OMPF. There is no corresponding diploma. 3. PO 337-49, issued by U.S. Army John F. Kennedy Special Warfare Center and School, Fort Bragg, NC on 2 December 2008, awarded him the Military Free Fall Parachutist Badge upon completion of the Military Free Fall Parachutist Course. The date(s) or period of service for this course were 19 November to 18 December 2008. 4. His record also contains a diploma showing he attended and completed the Military Free Fall Parachutist Course on 18 December 2008. 5. On 10 March 2017, Staff Sergeant (SSG) WT submitted a request to HRC to remove a misfiled document (PO 6-30). He commented the Soldier did not graduate from the course in 2006. Student records personnel erroneously prepared and then misfiled the document. The applicant completed the course in 2008. 6. The applicant provided emails showing: * he states he did not graduate from the course in 2006 * he requested assistance from his S1 and HRC to remove PO 6-30 * he was told the moving of awards from the performance folder to the service folder can only be accomplished by submitting a revocation order from S-1, unless the document is a duplicate * HRC must have a revocation order before PO 6-30 can be moved * his main concern at this point is removing the duplicate orders from his board file REFERENCES: Army Regulation 600-8-104 (Army Military Human Resources Record (AMHRR) Management) prescribes the policies and mandates operating tasks for the Military Personnel Information Management/Records Program of the Military Personnel System. It provides detailed guidance and instructions with regard to the initiation, composition, maintenance, changing, access to, and transfer of the OMPF. Table B-1 shows award orders (includes badges, bars, tabs, and so forth) are filed in the performance portion of the OMPF. The Army Board for Correction of Military Records may direct removal or movement of documents filed in the OMPF in the interest of justice or equity. DISCUSSION: 1. The applicant's OMPF contains PO 6-30, dated 6 February 2006. It also shows he attended the Military Free Fall Parachutist Course in 2008 and graduated on 18 December 2008. At that time he was issued an order and diploma awarding him the Military Free Fall Parachutist Badge. 2. The evidence shows an administrative error occurred when PO 6-30 was completed and filed in the applicant's OMPF without any record of course completion.
