THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 17 July 1986 to show: * Korea Defense Service Medal * Additional skill identifier (ASI) “X” (Drill Sergeant) * Secondary military occupational specialty (SMOS) 11B2X * He was promoted to sergeant (SGT)/E-5 * his second honorable discharge 2. The applicant states he served in Korea from 1985 to 1986 as military police (MP) assigned to the 188th MP Company, Camp Walker. He also states he graduated from the Drill Sergeant Course in 1988 and was awarded ASI “X.” In 1989, he was promoted to SGT/E-5 in primary MOS (PMOS) 95B2X (MP) and MOS 11B2X (Infantryman) became his SMOS. In 1993, he received a second honorable discharge. 3. The applicant provides the following documents: * Letter from the National Personnel Records Center (NPRC), St. Louis, MO, dated 21 September 2005 * Certificate of Promotion for the rank of specialist four, dated 1 June 1985 * Letter, subject: Additional Duty Appointment (Officer/Enlisted Personnel), dated 21 August 1985 * Certificate of Achievement, dated 16 December 1985 * Letters of Appreciation, dated 23 and 29 January 1986 * DD Form 214 for the period 1 September 1983 to 17 July 1986 * DA Form 1059 (Service School Academic Evaluation Report), dated 18 March 1988 * Certificate showing completion of the U.S. Army Reserve (USAR) Drill Sergeant Course on 18 March 1988 * Orders 1-9, from Headquarters, 1st Brigade, 80th Division (Training) * Orders D-06-353506, from the USAR Personnel Center, dated 29 June 1993 * Honorable Discharge Certificate, dated 29 June 1993 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army (RA) on 1 September 1983. He completed the training requirements and he was awarded MOS 95B on 18 January 1984. He served in Korea from 10 April 1985 to 10 July 1986. 3. On 17 July 1986, he was honorably released from active duty and transferred to a USAR in the rank of specialist four/E-4. His DD Form 214 shows he completed 2 years, 10 months, and 17 days of net active service this period and 1 year, 3 months, and 8 days was foreign service. This DD Form 214 also shows award of the Good Conduct Medal, Army Service Ribbon, Overseas Service Ribbon, Army Lapel Button, Sharpshooter Marksmanship Qualification Badge (Hand Grenade), Expert Marksmanship Qualification Badge (Rifle M-16 and .45 Caliber Pistol). Additionally, this DD Form 214 shows he completed the 16-week Law Enforcement Course in January 1984). 4. On 10 February 1988, the applicant was ordered to report to annual training at Fort Jackson SC, not later than 5 March 1988, for a period of 15 days to complete the Drill Sergeant Course. 5. He completed the Drill Sergeant Course, as part of the nonresident program, from March 1987 to March 1988. Completion of the course authorized award of ASI “X.” A certificate, dated 18 March 1988, shows he successfully completed the requisite course of study prescribed for a USAR Drill Sergeant and he was declared a graduate on this date. 6. His DA Form 2-1 shows in item 6 (MOS) he was awarded MOS 95B20 effective 18 January 1984 and MOS 11B2X effective 16 July 1988. 6. While a member of the USAR, he was promoted to SGT/E-5 with an effective date and date of rank of 1 January 1989. 7. On 29 June 1993, he was honorably discharged from the Ready Reserve. 8. An NPRC letter, dated 21 September 2005, shows in addition to the awards listed on his DD Form 214, he was entitled to the National Defense Service Medal and Army Reserve Components Achievement Medal (ARCAM). (Both awards were for service completed after he was released from active duty in 1986.) REFERENCES: 1. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. A DD Form 214 will be prepared for each Soldier upon termination of active duty by reason of administrative separation (including separation by reason of retirement or expiration of term of service), physical disability separation, or punitive discharge. 2. Army Regulation 600-8-22 states the Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. DISCUSSION: 1. The applicant served in an active duty status from 1 September 1983 to 17 July 1986 and he served in Korea from on or about 10 April 1985 to 10 July 1986. This service met the criteria for the Korea Defense Service Medal, which may be added to his DD Form 214. 2. After he was honorably released from active duty, the applicant completed the Drill Sergeant School, was awarded ASI “X,” was awarded MOS 11B, was promoted to SGT/E-5, and was honorably discharged from the USAR. 3. The purpose of the DD Form 214 he was issued was to document his period of active duty service.
