The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conduced a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, item 12d of his DD Form 214 should be corrected to add 19 more days of prior active service. Additionally, his DD Form 214 is missing the Global War on Terrorism Expeditionary Medal in item 13 and an entry that captures his service in Kuwait in item 18. 3. The applicant's record contains a DD Form 214, which shows he entered active duty for training (ADT) on 8 June 2008 and he was released from ADT on 30 October 2008. Item 12c (Net Active Service This Period) of this DD Form 214 shows he competed 4 months and 23 days of active duty service. 4. On 17 February 2009, the applicant was ordered to ADT for Airborne, Pre-Ranger, and/ Ranger for the period ADT until completion unless released early or extended by the proper authority. His period of temporary duty (TDY) was from 10 April 2009 through 17 July 2009 (3 months and 8 days). The applicant's available record: * does not include a DD Form 214 for this period * is void of orders, which show when he was released from ADT * does not show whether he completed the course * the course is not listed on his Officer Record Brief 5. On 8 November 2010, the applicant was ordered to active duty in a voluntary indefinite status with a minimum 3-year period active duty obligation. 6. On 10 April 2011, the applicant was ordered to deploy in a temporary change of station (TCS) status in support of Operation Enduring Freedom, Afghanistan for a period not to exceed 365 days, with a "will proceed date" of on or about 28 May 2011. His record shows he completed a 7 month combat tour in Afghanistan on 15 December 2011. 7. On 11 February 2015, the applicant was ordered to permanent change of station (PCS) to Camp Arifjan, Kuwait and he was authorized an entitlement for foreign duty and hostile pay. His record shows he completed a 12 month operational tour in Kuwait, on 3 March 2015. 8. On 1 December 2016, he was discharged from active duty. He completed 6 years and 24 days of active service that was characterized as honorable. His DD Form 214 shows the following: a. Block 12f (Foreign Service) – "0001 00 01," b. Block 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized), is void of an entry for the Global War on Terrorism Expeditionary Medal, and c. Block 18 (Remarks): "SERVICE IN AFGHANISTAN 20110514 – 20111215." [7 months and 1 day] 9. The applicant provides a DD Form 214WS which shows an entry in item 18 "SERVICE IN KUWAIT 20140302 – 20150303." [1 year and 1 day] 10. An email from Defense Finance and Accounting Service (DFAS) dated 20 May 2017 stated the applicant was in the combat zone from 1 March through 31 March 2015. 11. Army Regulation 600-8-22 (Military Awards) states Global War on Terrorism Expeditionary Medal is authorized for award to members of the Armed Forces of the United States who deployed abroad for service in Global War on Terrorism operations on or after 11 September 2001 to a date to be determined. 12. Army Regulation 635-8 (Separation Documents) provides the following guidance ofr completion of the DD Form 214: a. Item 12d includes the total amount of prior active military service from previously issued DD Forms 214 less lost time, if any. b. Foreign service, taken from the ERB, performed during the period covered in item 12c (Net Active Service This Period) of the individual's DD Form 214 would be entered in item 12f. c. When an active duty Soldier was deployed with his or her unit during the period covered by the DD Form 214, the entry "SERVICE IN (name of country) FROM (inclusive dates in YYYY/MM/DD format)" would be entered in item 18. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was warranted for the requested Global War on Terrorism Expeditionary Medal (GWOTEM) as well evidence of the applicant’s service in Kuwait, from 20140302 – 20150303. The Board did not find evidence of the applicant’s 19 additional days of service. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned, be corrected by adding the GWOTEM and service in Kuwait for the dates specified above. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to the additional 19 days of active service annotated on his DD Form 214. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-8 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. It states the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate and reflects the conditions as they existed at the time of separation. a. Item 12d includes the total amount of prior active military service from previously issued DD Forms 214 less lost time, if any. b. Foreign service, taken from the ERB, performed during the period covered in item 12c (Net Active Service This Period) of the individual's DD Form 214 would be entered in item 12f. c. When an active duty Soldier was deployed with his or her unit during the period covered by the DD Form 214, the entry "SERVICE IN (name of country) FROM (inclusive dates in YYYY/MM/DD format)" would be entered in item 18. 3. Army Regulation 600-8-22 (Military Awards) states the Global War on Terrorism Expeditionary Medal (GWOTEM) is authorized for award to members of the Armed Forces of the United States who deployed abroad for service in Global War on Terrorism operations on or after 11 September 2001 to a date to be determined. The general area of eligibility (AOE) encompasses all foreign land, water, and air spaces outside the fifty states of the United States and outside 200 nautical miles of the shores of the United States in operations approved by the Secretary of Defense. a. Initial award of the Global War on Terrorism Expeditionary Medal was limited to service members deployed abroad in Operations Enduring Freedom and Iraqi Freedom in designated specific geographic areas of eligibility (AOE) that included Kuwait. b.
