(Type of Transfer or Discharge) * Block 12 (Reason and Authority) * Block 14 (District, Area Command or Corps to Which Reservist Transferred) * Block 18 (Prior Regular Enlistments) APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record). FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he would like the following administrative errors corrected on his DD Form 214: * Block 11a. – should be blank * Block 12 – should read Ft. Wainwright, Alaska * Block 14 – should read N/A because he was drafted for the regular Army and in error was ordered to Camp Shelby, Mississippi for annual training * Block 18 – should be blank 3. A review of the applicant’s service record shows: a. He was inducted into the Army of the United States on 13 October 1966. b. He served in Alaska from 1 March 1967 to 13 September 1968. c. Special Orders Number 257, dated 13 September 1968, stated the applicant was released from active duty, not by reason of physical disability, effective the following day. The individual would be transferred to United States Army Reserve (USAR) control group as indicated. d. On 14 September 1968, he was honorably released from active duty. His DD Form 214 shows he completed 1 year, 11 months, and 2 days of active service. It also shows: * Block 11a. – transferred to USAR (See Item #16 – USAR obligation end date 12 October 1972) * Block 12 – 568th Trans Co, APO 98731, Ft. Wainwright, Oklahoma * Block 14 – USAR Control Group (Annual Training) USAAC St. Louis, Missouri * Block 18 – None 4. By regulation, in effect at the time, the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. a. Item 11a. – if the enlisted person incurred a Reserve obligation under title 10, United States Code, subsection 651a and is being transferred to the Army Reserve for the purpose of satisfying that obligation, the entry “Transferred to USAR” will apply. b. Item 12 – enter the last duty assignment and major command. c. Item 14 – if at the time of separation the individual is transferred or reverts to USAR or ARNGUS enter for USAR individuals, Control Group (Annual Training or Reinforcement) and USAAC, 9700 Page Boulevard, St. Louis, MO 683132, i.e., transferred (or release to USAR Control Group (Annual Training), USAAC, St. Louis, MO. d. Item 18 – enter the number of prior Regular army enlistments the individual has completed. For officers, enter “NA.” BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined partial relief was warranted. Based upon the documentary evidence provided by the applicant, found within the military service record and the facts and circumstances of the applicant’s military service, the Board concluded that the information reflected in Box 12 of his DD Form 214 should reflect “Fort Wainwright, Alaska” and should be corrected. However, all other information on the DD Form 214 was found to correctly reflect the military service of the applicant. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by: * Changing Item 12 to read, “568th Trans Co, APO 98731, Ft Wainwright, Alaska” 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to all other requested relief. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) in effect at the time, states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge.
