APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 dated 22 January 1973 * Letter from the National Personnel Records Center (NPRC) dated 13 December 2016 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his MOS is 43E2P (Parachute Rigger) and that it should be corrected to show he was also awarded the MOS 11B10 (Infantry). 3. A review of the applicant’s service record show the following: a. He enlisted into the United States Army on 13 April 1970. b. DD Form 20 (Enlisted Qualification Record) shows item 38 (Record of Assignments) Light Weapons Infantry Advanced Individual Training (AIT) on 29 June 1970 and 43E2P (Parachute Rigger) on 20 October 1970. c. Special Orders Number 21 Extract dated 29 January 1971, MOS withdrawn 11B10, MOS awarded P43E2P. d. Special Orders Number 250 Extract dated 19 December 1972 reflect applicant’s MOS as 43E2P. e. Special Orders Number 15 Extract dated 22 January 1973 relieved the applicant from active duty effective 22 January 1973 with MOS 43E2P reflected. f. DD Form 214 for period ending 22 January 1973, shows in item 23a Specialty Number and Title 43E2P, Parachute Rigger. g. Letter Orders Number 03-1049943, Subject Discharge USAR, dated 25 March 1976 reflects applicant’s MOS as 43E2P honorably discharging him for expiration of term of service. 4. Army Regulation 614-200 (Enlisted Assignments and Utilization Management) states Soldiers will be assigned to an organizational element according to the authorized MTOE (modified Table of Organization and Equipment/TDA (Table of distribution and allowances)/DMOS (Duty MOS) positions, consistent with their PMOS (Primary MOS) qualifications. 5. AR 635-5 (Personnel Separations Separation Documents) item 23a in para 2-40, in effect at the time, enter primary MOS code number, title, and date of award. In addition enter PMOS (Primary MOS) evaluation score and date of score. If the enlisted person has not received a PMOS evaluation score, enter “None.” If more space is required, enter “see 30” and continue remark in item 30. If the specialty represented by the MOS has a related civilian occupation, enter in item 23b the appropriate job title and code number from the dictionary of Occupational titles. If not applicable, enter “NA.” 6. The DD Form 214 is a summary of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. The applicant’s DA Form 20 indicates his primary MOS was 43E. The applicant’s record shows he did go to school for infantry, but the MOS is withdrawn. The DD Form 214 shows the MOS at the time of separation. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 614-200 (Enlisted Assignments and Utilization Management) states that Soldiers will be assigned to an organizational element according to the authorized MTOE/TDA/DMOS positions, consistent with their PMOS or CPMOS qualifications. 3.
