The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, the social security number is incorrect on his DD Form 214. The incorrect SSN reflected on his DD Form 214 is “XXX--XXXX.” His correct SSN is “XXX--XXXX. 3. The applicant provides copies of his: * VA identification card, which reflects his name and a photograph of himself * California DL, which reflects his name and date of birth * social security card, which reflects the correct SSN as “XXX--XXXX” 4. The applicant's service record in its entirety is unavailable for the Board to review. However, his DD Form 214 reflects he enlisted in the Regular Army on 15 May 1979 and was discharged on 15 September 1983 under the provisions of AR 6-200, chapter 13, unsatisfactory performance, and a characterization of service of general, under honorable conditions. Item 3 (Social Security Number) of his DD Form 214 shows his SSN as "XXX--XXXX." 5. Army Regulation 6-5 (Separation Documents), dated 15 August 1979, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It stated to transcribe the SSN at the time of separation from applicable documents in item 3. BOARD DISCUSSION: After review of the application and all evidence, the Board determined relief was warranted. The applicant’s contentions were carefully considered. He provided a social security card that shows the middle two digits of his SSN were transposed when the DD Form 214 was completed. The Board agreed to grant relief and correct the separation document. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the current social security number (SSN) shown on his DD Form 214 and replacing it with the SSN shown on his social security card. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 6-5 (Separations Documents), prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
