The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 is incorrect regarding his Foreign Service period. He states it should read 3 years and 29 days. He reenlisted in the Army in Fort Knox July 1974 with his chosen location to be stationed at overseas was Okinawa, Japan. His service record does not indicate his duty assignment at Okinawa, Japan. He reports he was assigned from August 1974 to August 1975. He served a second tour in Korea from August 1975 to September 1976. 3. The applicant further states how he was assigned to the U.S. Army Medical Supply Depo for six months and assigned to the Army Hospital for the other six months in Okinawa. His orders to return to Korea in 1975 included orders for him to attend Food Service Training in San Antonio, TX. His final orders were to the 4th Combat Support Hospital at Fort McClellan, AL. He states his company commander in Okinawa was investigated by the Inspector General for multiple unjust article 15s and he named the mess hall sergeants at Okinawa and at Korea. 4. The applicant enlisted in the Regular Army on 22 July 1974. He received an honorable discharge on 20 July 1979. 5. According to his DA Form 2-1 (Personnel Qualification Record) section 35 (Record of Assignments), the applicant served a total of 3 years 2 months and 7 days in the following overseas assignments: * 16 December 1972 – 22 January 1974, Co B 307th SIG BN USARPAC, Korea * 06 September 1974 – 24 February 1975, USAMMAPAC, Okinawa, Japan * 25 February 1975 – 2 September 1975, USA Hospital, Okinawa, Japan * 3 September 1975 – 30 April 1976, HHC 307th SIG BN, Korea * 1 May 1976 – 13 October 1976, HHC 304th SIG BN, Korea 6. Army Regulation 635-5 (Separation Documents) states a DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty service. DA Form 2-1 (Personnel Qualification Records), enlistment/reenlistment documents, orders, and any other available records in the preparation of the DD Form 214. a. Item 18 (Record of service). For detailed instructions on computation of basic pay, see chapter 1, DODPM. All service shown in 18(a) through (e) will be less time lost under title 10 USC 972 and time lost subsequent to expiration of term of service. b. Item 19 (Indochina or Korea service since August 5, 1964). For Vietnam service, place an "X" in the "yes" block and give specific dates of service (see fig. 2-1). Specific dates are not required for Korea." c. item 27 (Remarks). The remarks section will be used for entries required by HQDA for which a separate item is not available on the form and for completing entries that are too long for their respective blocks. When completing a long entry, the item number being completed must precede continuation of the comment in item 27. Sample required entries, as applicable, for item 27 are provided in (1) through (18) below. “(13) Enter the country and dates which the last period of oversea service was performed.” BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was warranted. Based upon the documentary evidence presented by the applicant or found within his military personnel file, the Board found that the request by the applicant warranted changing the record to reflect all changes requested. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established the standardized policy for preparing and distributing the DD Form 214. It provided that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty, providing a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. a.
