The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. On 17 May 1995, the applicant enlisted into the Regular Army for a period of 3 years. 3. On 1 November 1997, the applicant requested to reenlist in the Regular Army while assigned to Headquarters and Headquarters Troop, Regimental Support Squadron, 2nd Armored Cavalry Regiment, Guardian Base, Bosnia APO AE 09789. She reenlisted for a period 3 years on 7 November 1997 in the country of Bosnia, APO AE 09789. Her available record is void of orders for an assignment Outside of the Continental United States (OCONUS) or a deployment in support of Operation Joint Guard [Peacekeeping Mission]. 4. On 3 November 2000 she was released from active duty. Her DD Form 214, item 12f shows her completed period of Foreign Service as "0000 00 00" and item 18 1. (Remarks) is void of an entry for a period of service in a designated imminent danger pay area or OCONUS country. 5. The applicant provides an Operation Joint Guard, Scroll of Appreciation which is undated and does not provide an entry for the dates of the operation or OCONUS period of service. 6. The applicant's available record and the Interactive Personnel Electronic Records Management System (iPERMS) is void of an Enlisted Records Brief. 7. An email from the Defense Finance and Accounting Service (DFAS), dated 6 March 2019, shows the applicant served in Bosnia (Country Code: BK) during her period of service from 1 September 1997 through 31 March 1998 (7 months and 1 day). 8. Army Regulation 635-5 (Separation Documents) stated that the entry in item 12f of the DD Form 214 is all foreign service performed during the period covered by the DD Form 214. This regulation also stated that when an active duty Soldier was deployed with his or her unit during the period covered by the DD Form 214, the entry "SERVICE IN (name of country) FROM (inclusive dates in YYYY/MM/DD format)" would be entered in item 18. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was warranted. Based upon the finance records of the applicant, the Board concluded that the request of the applicant is supported by available documentary evidence. For that reason, the Board recommended granting the applicant’s request for relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending his DD Form 214 by: adding in item 18, the entry "SERVICE IN BOSNIA FROM 1997/09/01 to 1998/03/31" and adding in Item 12f, the entry "0000 07 01". Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214. It states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. a. Foreign service, taken from the ERB, performed during the period covered in item 12c (Net Active Service This Period) of the individual's DD Form 214 would be entered in item 12f. b. When an active duty Soldier was deployed with his or her unit during the period covered by the DD Form 214, the entry "SERVICE IN (name of country) FROM (inclusive dates in YYYY/MM/DD format)" would be entered in item 18.
