APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant enlisted in the Regular Army on 12 June 1984. 3. The applicant's DA Form 2-1 (Personnel Qualification Record – Part II) shows he, while serving on active duty, was assigned to Company B, 39th Engineer Battalion, Fort Devens, MA from on or about 23 October 1984 through on or about 11 June 1986. 4. The applicant was honorably released from active duty on 11 June 1986 and was transferred to the United States Army Reserve (USAR) Control Group (Annual Training). Item 12f (Foreign Service) of his DD Form 214 contains the entry "00 00 00." 5. A review of his official military personnel file contained no evidence that he served in an assignment outside the continental United States or that he was put on orders for a deployment. Additionally, his record contained no letter of commendations. 6. Army Regulation 635-5 (Separation Documents), dated 1 July 1981, stated to enter for item 12f the total amount of foreign service completed during the period covered by the DD Form 214. Additionally, it does not provide for the listing of letters of commendation on the DD Form 214. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is insufficient evidence to grant relief. The applicant’s contention was carefully considered. Although commendatory letters are not placed on the DD Form 214, his record is absent evidence he received a letter of commendation. In addition, the Board agreed the record is absent evidence that shows he served in outside the continental United States during his period of service. Army Regulation 635-5 (Separation Documents), dated 1 July 1981, prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. Item 12f (Foreign Service) states to enter the total amount of foreign service completed during the period covered by the DD Form 214.
