The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states block 5 of his DD Form 4 (Enlistment/ Reenlistment Document) should be 13 May 2009 instead of 21 March 2007. 3. The applicant provides: * DD Form 4 (Enlistment/ Reenlistment Document), showing his enlistment date * DD Form 2808 (Report of Medical Examination) * DA Form 705 (Army Physical Fitness Test Scorecard) * DA Form 1059 (Service School Academic Evaluation Report) * Orders 287-83 (Military Occupational Specialty 68P (Radiology Specialist)) * Radiology Course Completion Certificate * Army Medical Department Affiliation Certificate * DD Form 214 (Certificate of Release or Discharge from Active Duty) 4. Review of the applicant’s service records shows: a. His DD Form 4 (Enlistment/ Reenlistment Document) shows in block 5 his enlistment date as 21 March 2007 and in block 18b 13 May 2009. b. His DD Form 1966, also has 21 March 2007 and signed 13 May 2009 c. He completed course 313-68P10 (Radiology Specialist) from 5 November 2007 to 20 October 2008. d. Orders number 287-83, dated 13 October 2008, award the applicant military occupational specialty P68P2O effective 20 October 2008. e. On 20 October 2008, the applicant was released from active duty training by reason completion of required active service. His DD Form 214 (Certificate of Release or Discharge from Active Duty) shows he completed 11 months and 19 days of active service. It also shows he had 6 years and 4 months of prior active service. 5. By regulation (AR 601-210) an applicant applies voluntarily for enlistment in the RA or USAR and is found eligible for further processing after completing and signing the DD Form 1966. An enlistee has enlisted in the DEP, RA, USAR, or ARNG. An applicant becomes an enlistee after the oath of enlistment is taken and applicable portions of the DD Form 4 are signed. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was not warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board concluded there was insufficient evidence of an error or injustice which would warrant making a change to the applicant’s military record. As a result of the applicant signing the original document with the contested date, as well as a lack of demonstrated harm to the applicant if the date was incorrectly reflected, the Board concluded to leave the date as reflected and deny the applicant’s request. The Board did wish to inform the applicant that if he can demonstrate through additional evidence that the date is in correct or some injustice or harm created from the possible erroneous date that he may resubmit for reconsideration. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 601-210 (Regular Army and Reserve Components Enlistment Program), then in effect, prescribes the authority to act on claims of erroneous entries on enlistment documents that are not delegated elsewhere in this chapter or in AR 600–8–104 is delegated to Commander, U.S. Army Human Resources Command, 1600 Spearhead Division Avenue, Fort Knox, KY 40122–5303, for RA and USAR or Chief, National Guard Bureau, 1411 Jefferson Davis Highway, Arlington, VA 22202– 4127, for ARNG. Requests relating to claims of erroneous entries must include a statement signed by the person; attach copies of substantiating documents that will assist in making a decisions at the time. An applicant applies voluntarily for enlistment in the RA or USAR and is found eligible for further processing after completing and signing the DD Form 1966. An enlistee has enlisted in the DEP, RA, USAR, or ARNG. An applicant becomes an enlistee after the oath of enlistment is taken and applicable portions of the DD Form 4 are signed.
