The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her last name as XXXXX instead of XXXXX. 2. The applicant states her name change is due to divorce. This is an injustice as it affects her benefits. THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records with supporting document(s): * Final Judgment of Dissolution of Marriage, dated 28 July 2016 2. Evidence from the applicant’s service record and Department of the Army and Department of Defense records and systems: * DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States), dated 22 May 1992 * DA Form 5960 (Authorization to Start, Stop, or Change Basic Allowance for Quarters (BAQ) and/or Variable Housing Allowance (VHA)) dated 30 September 2012 * Enlisted Record Brief * DD Form 214 for the period ending 30 April 2015 REFERENCES: Army Regulation 635-8 (Personnel Separations – Separation Processing and Documents) prescribes policy and procedural guidance relating to transition management. It explains separation document preparation, distribution, correction, and transition processing. The DD Form 214 is a summary of the Soldier’s most recent period of continuous active duty. It provides a brief, clear- cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement or discharge. The rules for completing the DD Form 214 state for Block 1 (Name) to compare original enlistment contract or appointment order and review official records for possible name changes. If a name change has occurred, normally while in service, list other names of record in Block 18 (Remarks). DISCUSSION: 1. The applicant enlisted in the Regular Army on 22 May 1992 under the last name of XXXXX XXXXXX. 2. On 30 September 2013, she recertified her DA Form 5690, her BAQ authorization request for three dependents. She completed this form using the last name XXXXX XXXXXX and her date of marriage is shown as 7 April 1995. 3. Her electronic personnel record does not contain the personnel action request wherein she requested her last name be changed to XXXXXX after her date of marriage in 1995. 4. In preparation for separation processing an Enlisted Record Brief was prepared on 1 April 2012. This record shows her last name as XXXX XXXXXX. 5. On 30 April 2012, she was honorably retired due to sufficient length of service. Block 1 of her DD Form 214 shows her last name as shown on her DA Form 5690 and Enlisted Record Brief. A review of Block 18 does not show her name as shown on her first enlistment document (DD Form 4) normally required by regulation. 6. On 28 July 2016 she was divorced. She provides a Final Judgment of Dissolution of Marriage wherein the court ordered her last name changed to XXXX XXXXX, her maiden name and name shown on her initial 1992 DD Form 4. 7. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge.
