IN THE CASE OF: BOARD DATE: 19 December 2019 DOCKET NUMBER: AR20170006789 APPLICANT REQUESTS: her DD Form 214 (Certificate of Release or Discharge from Active Duty) to be corrected to reflect her foreign service time and most notably, her time served in support of Operation Desert Storm/Desert Shield, as well as her inactive time APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Three DD Forms 214 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant provides three DD Forms 214, two of which are illegible. The legible DD Form 214, item 18 (Remarks), covering the period of 28 August 2015 thru 16 July 2016, reflects she served in: * Kuwait from 19 September 2015 to 24 September 2015 (5 days) * Qatar from 24 September 2015 to 14 December 2015 (19 days) * Afghanistan from 14 December 2015 to 25 May 2016 (5 months, 10 days) * Kuwait from 25 May 2016 to 26 May 2016 (1 day) 3. A review of the applicant’s service record shows: a. She enlisted in the Army Reserves on 6 April 1988 and is currently serving. b. Her most recent DD Form 214, covering the period of 22 September 2017 to 29 July 2018, reflects the following: * Item 12e (Total Prior Inactive Service): 25 years * Item 12f (Foreign Service): 8 months and 18 days * Item 18 (Remarks): Service in Kuwait, 29 September 2017 to 16 June 2018 4. Army Regulation (AR) 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board concluded that there was insufficient evidence to show that the applicant served during Operation Desert Shield/Desert Storm. However, all other requested information was reflected on the applicant’s DD Form 214, ending date of 29 July 2018 (in block 12c and block 18). As a result, the Board found no relief warranted. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. AR 635-5, in effect at the time, prescribes the separation documents that will be furnished each individual who is separated from the Army. a. Paragraph 2-4h (12)(e) (Total Prior Inactive Service), states “from previously issued DD Forms 2I4 and/or ERB/ORB, enter the total amount of prior inactive service, less lost time, if any delayed entry program (DEP) time that began on or after 1 January 1985 is not creditable service for pay purposes and will not be entered in this block. b. Paragraph 2-4h (12) (f) (Foreign Service) states, “from the ERB/ORB, enter the total amount of foreign service completed during the period covered in block 12f.” c.
