The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting the entry form the applicant's DD Form 214 (Certificate of Release or Discharge from Active Duty), at item 12f (Foreign Service); b. adding at item 12f on the DD Form 214 the entry 01 11 00; and c. adding at item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), the National Defense Service Medal. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her records to show: * 1 year and 11 months of foreign service * award of the National Defense Service Medal and the Southwest Asia Service Ribbon 2. The applicant states in a prior request her foreign service was listed under sea service. The correction removed the incorrect entry from item 12g (Sea Service) on her DD Form 214 (Certificate of Release or Discharge from Active Duty) but did not add the entry to item 12f (Foreign Service). Her DD Form 214 does not reflect ribbons authorized for service during Operation Desert Shield/ Desert Storm. 3. The applicant provides copies of: * DD Form 214 * DD Form 215 (Correction to DD Form 214) * US Army Signal Center and Fort Gordon request for correction to the applicant's Separation Documents, dated 15 March 1991 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant served on active duty from 5 August 1986 through 22 January 1991. 3. The applicant's DA form 2-1 (Personnel Qualification Record - Part II) shows: * service in Germany from 26 August 1988 through 25 July 1990 * award of the: * Army Service Ribbon * Army Achievement Medal * Overseas Service Ribbon * Army Good Conduct Medal * Sharpshooter Qualification Badge with Rifle Bar 4. On 22 January 1991, the applicant was honorably discharged due to physical disability with severance pay. 5. Her DD Form 214 shows: * item 12f (Foreign Service) 00 00 00 * item 12g (Sea Service) 01 11 00 * item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized): * Army Service Ribbon * Army Achievement Medal * Overseas Service Ribbon * Army Good Conduct Medal * Sharpshooter Qualification Badge with Rifle Bar * item 18 (Remarks) is silent for any deployment to an area of eminent danger 6. On 25 April 1991 a DD Form 215 was issued showing at item: * 12g, deletion of the entry 01 11 00 * 12e, addition of the entry 00 00 00 7. A review of the Gulf War Roster failed to locate any reference to the applicant. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) provides the following: a. The National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 and a date to be determined. b. The Southwest Asia Service Medal is awarded to members of the Armed Forces of the United States serving in Southwest Asia and contiguous waters or airspace there over, on or after 2 August 1990 to 30 November 1995. To be eligible, a service member must meet one or more of the following criteria: * Be attached to or regularly serving for one or more days with an organization participating in ground or shore (military) operations * Be attached to or regularly serving for one or more days aboard a naval vessel directly supporting military operations * Be actually participating as a crew member in one or more aerial flights directly supporting military operations in the designated areas * Be serving on temporary duty for 30 consecutive days or 60 nonconsecutive days; these time limitations may be waived for people participating in actual combat operations DISCUSSION: 1. The applicant served on active duty during a period for which the National Defense Service Medal is authorized. 2. The prior correction of the applicant's DD Form 214 correctly removed the erroneous entry at item 12g but did not correct the error in the omission of that same information at item 12f. 3.
