The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he wanted to attend Air Assault School; however, he missed the opportunity due to supporting the mission and various deployments. Although he is no longer capable of performing the physical demands of the course, he believes he could pass the knowledge portion of the course. Therefore, he requests the training he received throughout his service to stand for the physical activities of the course and that he be given the opportunity to prove his knowledge in order to earn his wings. 3. There is no evidence in the applicant's Official Military Personnel File, which shows he attended and successfully completed an air assault training course. 4. The Air Assault Badge requires satisfactory completion of an air assault training course according to the U.S. Army Training and Doctrine Command standardized Air Assault Core Program of Instruction, or completion of the standard Air Assault Course while assigned or attached to the 101st Airborne Division (Air Assault) after 1 April 1974. The badge approval authority is a division or separate brigade commander or the commander of the 101st Airborne Division (Air Assault). BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board discussed the applicant’s statement regarding his desire to attend Air Assault training and his missing the opportunity to do so, the lack of evidence supporting his attendance/graduation from Air Assault school and the requirements for award of the Air Assault Badge and associated skill identifier. The Board found insufficient evidence in the records or in that provided by the applicant to support a correction to his record. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted.
