THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests a DA Form 1059 (Service School Academic Evaluation Report), dated 27 July 2016, showing his Basic Special Operations Language Training (BSOLT) as Chinese be removed from his interactive Personnel Electronic Records Management System (iPERMS) record. 2. The applicant states upon graduation from military occupational specialty (MOS) 38B training, a mistake was made on his DA Form 1059 showing his BSOLT as Chinese; therefore, a second DA Form 1059 was prepared showing his BSOLT as Spanish. However, both DA Forms 1059 are in his iPERMS record. The incorrect DA Form 1059 should be removed. 3. The applicant provides two DA Forms 1059, one shows his BSOLT as Spanish and the other shows his BSOLT as Chinese. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army (RA) on 19 August 2008. He is currently serving on active duty as a member of the RA. 2. The applicant’s iPERMS record contains two DA Forms 1059: a. A DA Form 1059 shows he completed the Civil Affairs Specialist Qualification course from 7 February 2014 through 19 August 2016, he achieved course standards, completed all the requirements in the Civil Affairs Specialist Qualification Career Path, and he was awarded MOS 38B. His BSOLT is listed as Chinese (Class 006-15). b. A second DA Form 1059 shows he completed the Civil Affairs Specialist Qualification course from 9 September 2015 through 19 August 2016, he achieved course standards, completed all the requirements in the Civil Affairs Specialist Qualification Career Path, and he was awarded MOS 38B. His BSOLT is listed as Spanish (Class 003-15). 3. On 19 August 2016, U.S. Army Installation Management Command Orders 232-411 were published assigning the applicant to “0083 CA CA BN (TAC) (WA8HAA) Fort Bragg, North Carolina,” not later than 12 September 2016. These orders show his primary MOS/area of concentration (AOC) as 38B3P00QB. 4. A Department of the Army Special Operations Forces Strategic Language List (SLL) shows Digraph Code “QB” denotes Spanish. Digraph Code “CM” is listed as Mandarin Chinese. REFERENCES: Army Regulation 15-185 (Army Board for Correction of Military Records (ABCMR)) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the ABCMR. The regulation provides that the ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. DISCUSSION: 1. The evidence shows the applicant's iPERMS record contains a DA Form 1059 which erroneously lists his BSOLT as Chinese. A second DA Form 1059 was prepared showing his BSOLT as Spanish and both forms are filed in his iPERMS record. 2. Orders were published on 19 August 2016 showing his primary MOS/AOC as 38B3P00QB. According to the SLL, Digraph Code “QB” is the appropriate code for Spanish.
