The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the requested training courses should be listed on his DD Form 214. 3. Review of the applicant’s service records shows: a. Having had prior service in the U.S. Army Reserve (USAR), the applicant enlisted in the USAR on 1 November 1974 and reenlisted in the USAR 30 September 1976. b. He continued his service in the USAR throughout the 1970s and early 1980s. During his USAR service, he completed the following training courses: * Leadership Management Development Trainers Course, 1 May 1981 * Leadership and Management Development Course, 10 April 1981 * MWRRC Professional Development Course, 24 November 1980 * Train the Trainer Course, 29 August 1980 * Guidance Counselor Course, 16 December 1983 * Army Nurse Corps Recruiting Course, 28 January 1983 c. He reenlisted in the USAR on 29 July 1985, and entered active duty on that date. He served through multiple extensions or reenlistments in a variety of assignments. d. He retired on 31 July 1997. His DD Form 214, covering the active duty period 29 July 1985 to 31 July 1997 shows in Block 14 (Military Education and Training), completion of the Recruiting Station Commander Course, 3 weeks, 1985. e. He previously applied to this Board regarding an award and a different training course. The Board granted him relief with respect to both issues and recommended correction of his records to show the entry "Senior Noncommissioned Officer Course for Reserve Component Noncommissioned Officers, 8 weeks, June 1986." 4. By regulation (AR 635-5), the DD Form 214 is a synopsis of the Soldier's most recent period of continuous, active duty. The data to be entered in Block 14 will be from the Enlisted Record Brief, and will lists formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The Board noted that all requested training to be added was completed after his release from active duty. The DD Form 214 lists training completed during the period covered by the DD Form 214. As a result, the Board concluded there is no error or injustice which would warrant making a change to the applicant’s military record. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Document) states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous, active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. The data to be entered in Block 14 will be from the Enlisted Record Brief/Officer Record Brief, and will lists formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. This information is to assist the Soldier after separation ·in job placement and counseling; therefore, training courses for combat skills are not listed.
