ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 12 November 2019 DOCKET NUMBER: AR20170007656 APPLICANT REQUESTS: reconsideration, in effect, to add her Active Duty Special Work (ADSW) performed on her final DD Form 214 (Certificate of Release or Discharge from Active Duty) to reflect her new discharge date of 18 February 2006. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 293 (Application for the Review of Discharge from the Armed Forces of the United States). FACTS: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20160017629 on 3 April 2019 and AR20180006068 on 16 May 2018. 2. The applicant states an adjustment needs to be made per her new “Honorable Discharge Certificate” received with the new discharge date of 18 February 2006. 3. The applicant referenced in Item 8 (In Support of this Application, the Following Attached Documents are Submitted as Evidence) of her application, that she included a copy of her “Corrected Honorable Discharge”. Her application packet was void of said document. 4 A review of the applicant’s service record shows: a. She enlisted in the U.S. Army Reserve (USAR) in the Delayed entry Program (DEP) on 19 April 1996. She was discharged from the DEP and enlisted in the Regular Army for 4 years on 16 September 1996. b. On 14 September 2000, she was honorably released from active duty due to her completion of the required active service, and transferred to the USAR Control Group (Reinforcements). Her DD Form 214 shows she completed 4 years of active duty service with no lost time. c. Orders C-06-117003, dated 19 June 2001, shows she was released from the USAR Control Group (Reinforcement), and assigned to a USAR unit in St. Louis, MO, effective 18 June 2001. d. A DA Form 1059 (Service School Academic Evaluation Report), shows she attended the following courses: * 16 March 2003 through 29 March 2003, for a period of 14 days * 30 March 2003 through 11 April 2003, for a period of 12 days e. Orders A-05-391995, dated 5 May 2003, shows she was ordered to active duty for the period 19 May 2003 through 26 September 2003 (a period of 131 days). f. Orders A-05-391995A01, dated 25 June 2003 amended Orders A-05-391995 showing her end date of 26 September 2003 (included accumulated leave), by changing her released date from active duty on 27 June 2003, a period of 40 days, which included accumulated leave. g. A DD Form 214 for the period 7 December 2003 through 12 October 2005 shows she was ordered to active duty in support of Operation Iraqi Freedom and that she completed 1 year, 10 months, and 6 days of active duty service with no lost time. She was released from active duty and transferred to 428 TC Company, Jefferson City, MO., after completion of required active service. h. Orders 06-048-00014, shows the applicant was honorably discharged from the USAR, effective 18 February 2006. 5. The applicant previously submitted two additional requests for relief, in part, requesting to add her all of active duty or ADSW service on her DD Form 214. They are: * AR20160017629, dated 3 April 2019 * AR20180006068, dated 16 May 2018 6. The Board considered the applicant’s prior request in ABCMR Docket Number AR20160017629, (which included a copy of the applicant’s DA Form 5016 (Chronological Statement of Retired Points), dated 29 January 2019), but denied her request. The Board found that there was a lack of documentary evidence either provided with the application or within the applicant’s service record to support the requested relief. Within the Record of Proceedings (ROP), the Board stated, “the applicant had not exhausted all her administrative remedies to add her additional ADSW points to her Chronological Statement of Points Summary. She will need to contact the HRC and provide them with supporting documentation for his correction.” 7. Regarding AR20180006068, the Board notified the applicant, at that time, she had a duplicate application pending with the ABCMR, and informed her prior case would have to be processed first. This case was closed without action and prejudice. 8. Army Regulation 635-5 (Separation Documents) states a DD Form 214 will be prepared for each Soldier as indicated: RC Soldiers completing 90 days or more of continuous ADT, Full-Time National Guard Duty (FTNGD), ADSW, temporary tours of active duty (TTAD), or Active Guard Reserve (AGR) service. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board concluded that the last period of active duty served which was greater than 90 consecutive days ended on 12 October 2005. As a result the Board found insufficient evidence of an error or injustice which would warrant changing the applicant’s military service record. The Board wished to inform the applicant that a DD Form 214 only depicts active duty service greater than 90 consecutive days. If the applicant has other evidence showing she served in an active duty status for more than 90 consecutive days after 12 October 2005, the Board recommends she resubmit an application for reconsideration. The DD Form 214 is not intended to have any legal effect on termination of a Soldier’s service. A DD Form 214 will be prepared for each Soldier as indicated: RC Soldiers completing 90 days or more of continuous ADT, Full-Time National Guard Duty (FTNGD), ADSW, temporary tours of active duty (TTAD), or Active Guard Reserve (AGR) service.
