The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that he would like his SSN corrected on is DD Form 214 to reflect in item 3, the SSN of XXX-XX-XXXX. Currently, his DD Form 214 (item 3) shows XXX-XX-XXXX. 3. The applicant provides a copy of his SSN card that shows SSN XXX-XX-XXXX, and a copy of his DD Form 214 which shows (item 3) SSN XXX-XX-XXXX. 4. A review of the applicant’s service record shows the following: a. The applicant was appointed as a Reserve Commissioned Officer of the Army under Title 10 with an effective date of 29 April 1974 with a SSN of XXX-XX-XXXX. b. DA Form 873 (Certificate of Clearance and/or Security Determination), dated 29 April 1974, shows the applicants SSN as XXX-XX-XXXX. c. Letter Orders A-05044, dated 31 May 1974, shows the applicants SSN as XXX-XX-XXXX. d. DA Form 2-1, shows item 2 (SSN) as XXX-XX-XXXX. e. Special Orders 04-01, dated 28 April 1974, promotes the applicant to first lieutenant and his SSN is shown as XXX-XX-XXXX. f. He was discharged from active duty on 6 July 1975. His DD Form 214 shows that he completed 2 years of active duty service with an honorable character of service. Item 3 shows his SSN as XXX-XX-XXXX. g. Reason for Separation document, dated 7 July 1976, shows the applicants SSN as XXX-XX-XXXX. h. Promotion letter, dated 3 October 1977, shows the applicant’s SSN as 3xx-5x-x349. i. Orders D-12-304182, dated 16 December 1993, discharges the applicant from the USAR with an effective date of 16 December 1993 with an honorable character of service. His SSN is shown as XXX-XX-XXXX. 5. Army Regulation (AR) 635-5 (Separation Documents) DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty).will be issued to provide missing information or to correct any information. Item 3 (SSN) transcribe Social Security account number from DA Form 2139 (Military Pay Voucher). “DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty) will be issued to provide missing information.” DD Form 215 will be issued when the missing information becomes available. 6. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was warranted. The applicant’s contentions were carefully considered. The Army has an interest in maintaining the integrity of its records for historical purposes. The information in those records must reflect the conditions and circumstances that existed at the time the records were created. The Board agreed his separation document reflects a different SSN than what is listed on other documents within his record, and that his DD Form 214 should be corrected to show the SSN on his social security card. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 6 July 1976 by showing the SSN on his social security card.
