THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his previous request for correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the award of the Southwest Asia Service Medal (SWASM). 2. The applicant states while stationed at Fort Drum, NY in 1990, he was deployed to the Sinai Peninsula to support the war efforts in the Persian Gulf. 3. The applicant provides Section VII (Current and Previous Assignments) of his DA Form 2-1 (Personnel Qualification Record) and a document from the internet. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records, which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20160001661 on 9 December 2016. 2. The applicant provides evidence or argument, which warrants consideration by the Board. 3. The applicant enlisted in the Regular Army on 24 May 1978. 4. The applicant was honorably discharged on 29 January 1992 upon the expiration of his term of service. He completed 13 years, 8 months and 6 days of net active service with 6 years and 2 months of foreign service. The DD Form 214 he was issued shows he was awarded or authorized the: * Army Commendation Medal (2nd oak leaf cluster) * Army Achievement Medal * Army Good Conduct Medal (4th Award) * National Defense Service Medal * Noncommissioned Officer's Professional Development Ribbon * Army Service Ribbon * Overseas Service Ribbon * Multi-National Force and Observers Medal * Expert Marksmanship Qualification Badge with Rifle Bar (M16) * Army Lapel Button 5. Item 18 (Remarks) of the DD Form 214 he was issued does not contain an entry showing he deployed in support of any named operation or served in Southwest Asia. 6. The applicant’s name is not listed in the Defense Manpower Data Center (DMDC). The DMDC compiled the Operations Desert Shield/Desert Storm (the Gulf War) database, which is the primary file that contains one record for each active duty member who participated in theater. 7. The applicant provides a document from the internet pertaining to the 10th Mountain Division's history. It states in 1990, 2nd Battalion, 14th Infantry Regiment was sent to the Multi-National Force and Observers mission in the Sinai. He further provides Section VII (Current and Previous Assignments) of his DA Form 2-1 (Personnel Qualification Record) which shows his assignment to Headquarters and Headquarters Company, 2nd Battalion, 14th Infantry Regiment, Fort Drum, NY effective 18 July 1990. REFERENCES: 1. Army Regulation 15-185 (ABCMR) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the ABCMR. Paragraph 2-9 contains guidance on the burden of proof. It states that the ABCMR begins its consideration of each case with the presumption of administrative regularity, which is that what the Army did was correct. The ABCMR is not an investigative body and decides cases based on the evidence that is presented in the military records provided and the independent evidence submitted with the application. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. 2. Army Regulation 600-8-22 (Military Awards) states the SWASM is awarded to members of the Armed Forces of the United States who participated in Operations Desert Shield/Desert Storm in the designated area on or after 2 August 1990 to 30 November 1995. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved designated campaigns are: * Defense of Saudi Arabia (2 August 1990 to 16 January 1991) * Liberation and Defense of Kuwait (17 January to 11 April 1991) * Southwest Asia Cease-Fire (12 April 1991 to 30 November 1995) DISCUSSION: 1. The applicant provided a document from the internet pertaining to the 10th Mountain Division's history which states in 1990, 2nd Battalion, 14th Infantry Regiment was sent to a Multi-National Force and Observers mission in the Sinai. The applicant also provided evidence, which shows he was assigned to Headquarters and Headquarters Company, 2nd Battalion, 14th Infantry Regiment, Fort Drum, NY effective 18 July 1990. 2. There is no evidence in his available records that shows the applicant was awarded the SWASM and the applicant's name does not appear in the DMDC Operations Desert Shield/Desert Storm Database.
