The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his primary specialty branch on his DD Form 214 is in error. His specialty should be 13A Field Artillery not 14A Air Defense Artillery. He also states he completed the airborne course, but it is not reflected on his DD Form 214. 3. The applicant provides: a. A copy of his DA Form 1059 (Service School Academic Evaluation Report) showing he attended and completed the Field Artillery Basic Officers Course from 13 November 2011 to 10 April 2012. b. A copy of his airborne course diploma showing he completed the course on 22 August 2008, as a cadet. c. A copy of Permanent Orders 227-3168, dated 14 August 2008, awarding him the Parachutist Badge. d. A copy of his DA Form 1307 (Individual Jump Record) showing jumps he completed at Fort Benning as a cadet. e. A copy of his Memorandum appointing him as a Reserve Commissioned Officer of the Army. f. A self-authored statement stating his DD Form 214 list his primary specialty as 14A Air Defense Artillery, which is incorrect. His primary specialty should be listed as 13A Field Artillery. It also states he is seeking to have his Basic Parachute Badge added to block 13 of his DD form 214. 4. A review of the applicant’s service record shows: a. He was appointed as a Reserve Commissioned Officer of the Army and executed an Oath of Office on 28 July 2011, branch of service assigned Field Artillery. b. United States Army Human Resources Command (HRC), Fort Knox, KY published Order C-10-114920 on 27 October 2011 reassigning him to 442nd Infantry Regiment, Honolulu, HI as a second lieutenant in field artillery. He entered active duty on 13 November 2011. c. On 12 April 2012, the applicant was honorably released from active duty training and transferred to U.S. Army Reserve Control Group. His DD Form 214 shows in: * block 11 (Primary Specialty) 14A Air Defense Artillery – 0 YRS 0 MOS * block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): National Defense Service Medal Army Service Ribbon * Block 14 (Military Education) Field Artillery BOLC (Basic Officer Leader Course) 5. By regulation (AR 635-56), the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It states Item 11 shows the titles of all MOS's or area of concentration (AOC) served for at least 1 year (during the period covered by the DD Form 214) and include for each MOS/AOC the number of years and months served; for time determination, 16 days or more count as a month; basic combat and advanced individual training are not counted; for commissioned officers, specify the AOC consisting of two numerical digits and one letter. Item 13 shows all awards and decorations. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was warranted. Based upon the documentary evidence provided by the applicant and found within his military service record, the Board members agreed that the applicant completed the FA basic course, not the ADA course. His supporting documentations support MOS 13 and his award of the Parachutist Badge is awarded in orders. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214 (Certificate of Release or Discharge from Active Duty). Chapter 2 (Preparing and Distributing Separation Documents), Section I (DD Form 214), paragraph 2-1 (Preparing the DD Form 214), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. a. Paragraph 2-4h (11) Primary Specialty, from the enlisted record brief/officer record brief, enter the titles of all military occupational specialty (MOS) or area of concentration (AOC) served for at least 1 year and include for each MOS/AOC the number of years and months served. For time determination, 16 days or more count as a month. Do not count basic training and advanced individual training. For commissioned officers, also specify the AOC consisting of two numerical digits and one letter. b. Paragraph 2-4h (13) Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized, list all awards and decorations for all periods of service in the priority sequence specified in AR 600-8-22 (Military Awards).
