The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the last four numbers of his social security number (SSN) on his DD Form 214 and 215 are wrong. His DD Form 214 reads XXX-XX-XXXX and the DD Form 215 reads XXX-XX-XXXX. 3. The applicant provides: a. A copy of his DD Form 214 to show the original error of XXX-XX-XXXX. He had a correction and was issued a DD 215; however, the number on it is also wrong and reads XXX-XX-XXXX. b. A copy of his social security card with his name and social security number as XXX-XX-XXXX. 4. A review of the applicant’s service record shows: * 17 July 1986 – he enlisted in the Regular Army with the SSN XXX-XX-XXXX * 16 July 1989 – he was released from active duty; his DD Form 214 shows SSN XXX-XX-XXXX 5. On 21 March 2012, the applicant petitioned to have a correction to his separation date on his DD Form 214 of “89 07 10.” He was issued a DD Form 215 and his SSN was also corrected to read XXX-XX-XXXX. 6. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. With regard to item 3, the regulation required verification of accuracy with the SSN of record. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was warranted. The applicant’s contentions were carefully considered. Evidence of record shows he was issued a DD Form 215 correcting his SSN to show XXX-XX- XXXX. However, his social security card shows his SSN as XXX-XX-XXXX. The Board agreed there was an administrative error that should be corrected. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 16 July 1989 by showing the SSN listed on his social security card. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
