ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 3 September 2019 DOCKET NUMBER: AR20170008024 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to reflect his deployment to Operation Desert Storm in block 18 (Remarks). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he was assigned to the 324th Signal Battalion in Karlsruhe Germany when he was deployed to Incirlink Air Force Base Turkey and supported the 7th Special Forces Group from 13 February 1991 to 31 July 1991. His time served in support of Desert Storm/Desert Shield is not reflected and he requests that the dates and service be reflected on his DD Form 214. Over the years since his discharge he has lost his orders that assigned him to the 7th Special Forces Group during Desert Storm. 3. A review of the applicant’s service record shows the following: a. He enlisted on the Regular Army (RA) on 23 January 1986. He reenlisted on 3 August 1989 and 26 March 1993. b. He served in Korea from 18 January 1988 to 19 January 1989 and in Germany from 13 December 1989 to 22 February 1992. c. No evidence was found in the applicant’s service record to support the applicant’s claim of deployment in support of Operation Desert Storm from 13 February to 31 July 1991. d. Orders 101-10, dated 24 May 1994, discharged the applicant from active duty effective 24 May 1994. e. He was discharged from active duty on 24 May 1994. His DD Form 214 shows in block 12f (Foreign Service) that he completed 3 years, 2 months, and 12 days of Foreign Service. f. His name is not listed on the Gulf Roster. 4. AR 635-8 (Separation Processing and Documents) Block 18 (Remarks) use this block for HQDA mandatory requirements when a separate block is not available, and as a continuation for entries in blocks 9 (Command to which Transferred) blocks 11 (Primary Specialty), 13 (Decorations Medals), and 14 (Military Education). “DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty) will be issued to provide missing information.” DD Form 215 will be issued when the missing information becomes available. 5. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. The ABCMR limits corrective action to documents that can be individually reviewed after a Soldier's separation, such as the DD Form 214. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The applicant’s contentions were carefully considered. Based upon the documentary evidence provided by the applicant and found within his military service record, the Board found insufficient evidence showing he deployed to the Gulf War/ The Board agreed Americans in many capacities support the Nation’s war efforts; however, service members must deploy to the area of operations to receive Foreign Service credit. There is no error on his DD Form 214. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
