ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 20 June 2019 DOCKET NUMBER: AR20170008099 APPLICANT REQUESTS: correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 10 March 1970 to show in item 23a (Specialty Number and Title) his military occupational specialty (MOS) as 11C10 (Indirect Fire Infantryman) instead of 73C20 (Pay Dispersing Specialist.) APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect that a. Item 23a of his DD Form 214 lists his primary MOS (PMOS) as 73C2O, but his PMOS should read 11C1O. His PMOS was 11C1O, which is the MOS he served in during combat operations in Vietnam. b. When he was wounded in Vietnam and was discharged from the Army Hospital, he finished the remainder of his time in the Army as in MOS 73C (Clerk); however, he wants his records to reflect his PMOS as an 11C1O. 3. Item 23a of his DD Form 214 shows his MOS as 73C2O. 4. The applicant’s military records contain a DA Form 20 (Enlisted Qualification Record), which reflects the following information: a. Item 23 (MOS) – shows he received his secondary MOS for 11C2O on 12 July 1968 and he received his PMOS of 73C2O on 5 May 1969. b. Item 38 (Record of Assignment) - shows he was assigned to the following units: * Company A, 2nd Battalion 39th Infantry, 9th Infantry Division in duty MOS 11C10 from 12 July 1968 to 16 March 1969 * 501st Administration Command, 1st Armored Division in duty MOS 73C2O from 17 March 1969 to 10 March 1970 5. Army Regulation 635-5 (Separation Documents), states for item 23a in DD Form 214 to enter the PMOS. At the time of his discharge, the applicant’s PMOS was 73C2O. 6. On 10 March 1970, he was honorably released from active duty and transferred to the U.S. Army Reserve Control Group. 7. On 30 January 2015, he received a DD Form 215 (Correction to DD Form 214), which awarded him the Purple Heart, pursuant to General Orders Number 253, dated 7 November 1968 for wounds he received in connection with military operations against a hostile force in Vietnam on 6 November 1968. BOARD DISCUSSION: 1. After review of the application and all evidence, the Board determined that there is sufficient evidence to grant full relief. The record reflects that the applicant served 12 months in MOC 11C20, Infantry Indirect Fire Crewman. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5, dated 23 January 1967, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. For items 23a and 23b, enter PMOS code number and title. If the specialty represented by the MOS has a related civilian occupation, enter in item 23b the appropriate job title and code number from the dictionary of occupational titles. Army Regulation 635-8 (Separation Processing and Documents), dated 17 September 2019, prescribes procedures for entering school completion data in paragraph 5-6k: Enter the titles of all MOSs or areas of concentration (AOCs) awarded and held for at least 1 year during the current period of service and include for each MOS/AOC the number of years and months held. For time determinations, 16 or more days counts as a month. Do not count time in training (basic training, advanced individual training, Basic Officer’s Leader Course, or MOS-producing school).
