ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 17 September 2017 DOCKET NUMBER: AR20170008106 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his new address and to remove his spouse's name. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record under the Provisions of Title 10 U.S. Code, Section 1552) * DD Form 214, for the period ending 30 April 1993 FACTS: 1. The applicant did not file within the 3 year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: * he would like to change his address on the front of his DD Form 214, and * remove his spouse's name because they divorced on 28 October 2008 3. Having had prior service, he enlisted in the Regular Army on 16 February 1978. He served through multiple extensions or reenlistments in a variety of assignments. 4. He retired from active duty on 30 April 1993. His DD Form 214 shows in: * Block 19a (Mailing Address after Separation (Include Zip Code)) shows the mailing address the applicant provided at the time of his separation from Active Duty * Block 19b (Nearest Relative (Name and Address – include Zip Code)) shows the name and address of the nearest relative the applicant provided as the time of his separation from Active Duty. 5. By regulation (AR 635-5), the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. Chapter 2 contains guidance on the preparation of the DD Form 214. Block 19a and 19b show the mailing address and name of nearest relative after separation, as provided by the Soldier. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. The Board concluded that the information currently reflected on the applicant’s DD Form 214 was accurate at the time of separation. Any information that may change after the date of separation is not changed because the DD Form 214 captures military service and personal information at the time of separation only. For that reason, the Board concluded there is no error or injustice which would warrant making a change to the applicant’s record. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) in effect at the time, prescribed the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. Table 2-1 (DD Form 214 Preparation Instructions) provided for item 19a (Mailing Address After Separation) was obtained from the Soldier, Soldiers were advised that this must be a permanent address. Item 19b (Nearest Relative) was obtained from the Soldier, the name and address of a relative (permanently located) who will know the location and address of the Soldier at all times.
