ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS BOARD DATE: 15 October 2019 DOCKET NUMBER: AR20170008179 APPLICANT REQUESTS: an update of Item 12f (Foreign Service) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to include his Gulf War service. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 (Certificate of Release or Discharge from Active Duty FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he served time in Gulf War with the 101st Airborne Division (Air Assault) Division. His foreign service is not included on his DD Form 214. He served from approximately August 1990 to February 1991. 3. The applicant’s service records shows: a. He enlisted in the Regular Army on 25 March 1971. He reenlisted several times until his date of retirement on 31 March 1991. b. He served overseas tours in Vietnam from 2 September 1971 to 10 August 1972, in Germany from 7 September 1975 to 5 September 1978, in Hawaii from 31 December 1981 to 15 December 1984, and Korea from 12 May 1989 to 11 May 1990. He received normal tour credit for each overseas assignment. c. In Section VII – Current and Previous Assignments, Item 35 of his DA Form 2-1 (Personnel Qualification Record – Part II), he was assigned to Company A, 8th Battalion of the 101st Aviation Brigade, Fort Campbell, KY on 6 June 1990. d. On 31 March 1991, his DD Form 214 shows he retired honorably after serving 20 years and 6 days of active service. It also shows he was awarded or authorized * Army Service Ribbon * Noncommissioned Officer Professional Development Ribbon w/numeral 3 * Army Good Conduct Medal (6th Award) * Overseas Service Ribbon w/numeral 3 * Two Overseas Service Bars * Army Achievement Medal (4th Award) * Gold Recruiter Badge w/3 Sapphire Achievement Stars * Army Commendation Medal (3rd Award) * National Defense Service Medal * Driver and Mechanic Badge * Vietnam Cross of Gallantry w/Palm * Vietnam Service Medal w/3 Campaign Stars * Vietnam Campaign Medal * Vietnam Gallantry Cross Unit Citation w/60 Device * Presidential Unit Citation e. Item 18 (Remarks) of the applicant’s DD Form 214 does not show his dates of deployment in support of Operations Desert Shield and Desert Storm. 4. The Gulf War (Operations Desert Shield/Desert Storm) Database Roster compiled by the Defense Manpower Data Center shows the applicant served with the 101st Airborne (Air Assault) Division in the Gulf War from 1 October 1990 to 15 February 1991. 5. By regulation (AR 635-5), the DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The instructions stated for: * item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214 * item 18 for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (YYYYMMDD-YYYYMMDD)" BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was warranted. The applicant’s contentions were carefully considered. Evidence of record shows he served in the Gulf War; however, is DD Form 214 is void that information. The Board agreed to amend his DD Form showing his Gulf War service, and to add awards authorized for the deployment, if applicable. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 31 March 1991 by: a. item 13 – adding the following awards: * National Defense Service Medal (2nd Award) * Southwest Asia Service Medal with two bronze service stars * Kuwait Liberation Medal (Kingdom of Saudi Arabia) * Kuwait Liberation Medal (Kingdom of Kuwait) b. item 18 – adding the entry “Service in Southwest Asia from 19901001 – 19910215.” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) states: a. The Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM- SA) was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991. b. The Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-K) was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993. c. The Southwest Asia Service Medal is awarded to members of the Armed Forces of the United States serving in Southwest Asia and contiguous waters or airspace there over, on or after 2 August 1990 to 30 November 1995. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved designated campaigns are: * Defense of Saudi Arabia (2 August 1990 to 16 January 1991) * Liberation and Defense of Kuwait (17 January to 11 April 1991) * Cease-Fire Campaign (12 April 1991 to 30 November 1995) d. The National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 and a date to be determined. Second and subsequent awards of the National Defense Service Medal are denoted by a bronze service star affixed to the National Defense Service Medal. 3. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. It states for: * Item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214 * Item 13, to enter all awards, decorations, medals, badges, citations and campaign ribbons awarded or authorized for all periods of service * Item 18 (Remarks), for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" //NOTHING FOLLOWS// ABCMR Record of Proceedings (cont) AR20170008179 4 1
