APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Orders 057-173, issued by Headquarters, U.S. Army Combined Arms Support Command and Fort Lee (Provisional), dated 26 February 1991 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: a. His Orders for Operation Desert Storm were lost, and his foreign service time was not added to his DD Form 214. He found a copy of his Orders in some old files. b. The military was just building up units and not keeping track of where people were going due to the threat. c. The Board should consider adding his combat tour, so he can get credit for his service. He has fought the Department of Veteran Affairs (VA) for 9 years to get a post- traumatic stress disorder condition due to no record of his combat tour. 3. A review of the applicant's record shows a DD Form 214 for the period 27 December 1990 to 28 July 1995, does not contain any foreign service time or any statement in item 18 (Remarks) to show he served in support of Operation Desert Storm. 1. 4. His DA Form 2-1 (Personnel Qualification Record), item 5 (Oversea Service) contains the entry, from 24 March 1991 through 19 February 1993, he was assigned to Nana- Alaska. 5. The applicant provided a copy of Orders 057-173, dated 26 February 1991, which shows he received a temporary duty assignment to U.S. AG Fort Lee, VA, for deployment in support of Operation Desert Storm for 179 days. 6. The applicant's name is not listed in the Desert Shield/Storm Database compiled by the Defense Manpower Data Center (DMDC). The primary Desert Shield/Storm file contains one record for each active duty member who participated in-theater between 2 August 1990 and 31 July 1991 and one record for each Reservist, National Guard member, or retiree who was activated or federalized in response to Desert Shield/Desert Storm. A Phase II file lists active duty personnel who served in-theater between 1 August 1991 and 31 December 1993. There are also separate files covering calendar years 1994 and 1995. . 7. The applicant was honorable discharged on 28 July 1995 due to a reduction in force. He completed 4 years, 7 months, and 2 days of net active service this period, with 7 years, 3 months, and 12 days of prior active duty service. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was not warranted. The Board noted he had two overseas service ribbons and served both in Germany and Alaska. With no other evidence, the Board found insufficient evidence to show he actually deployed. For that reason, the Board found no error which would require correction. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It states for item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214. 3. Army Regulation 635-5 further states that for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)" will be entered in block 18 (Remarks).
