ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 26 April 2019 DOCKET NUMBER: AR20170008285 APPLICANT REQUESTS: in effect, correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty), with a separation date of 24 July 1992, to show her correct period of service for Desert Storm in the country of Iraq. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, she was in a basic leadership course and was later sent to Iraq for the year. She served in country for 3 months and was flown back home after her mother became terminally ill. Her DD Form 214 does not reflect the correct dates for her period of service during Desert Storm. 3. On 25 September 1979, the applicant enlisted into the Regular Army for a period of 3 years. 4. On 24 July 1992, the applicant was released from active duty. Her DD Form 214 shows: * item 12f (Foreign Service), shows "00 05 20" (0 years, 5 months, 20 days) * item 18 (Remarks), shows the entry "SERVICE IN SWA: 901017-- 910406" 5. The applicant's record provides a memorandum, Headquarters and Headquarters Company, 426th Signal Battalion which shows her dates for deployment to Operation Desert Shield and Operation Desert Storm as 17 October 1990 through 6 April 1991. Her record is void of orders which show her dates for deployment to Operation Desert Shield and Desert Storm. 1. 6. An email from the Defense Finance and Accounting Service (DFAS), dated 27 February 2019, states, in effect, the applicant was deployed to South West Asia (SA) from "910101 – 910430." BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was not warranted. Based upon the applicant not providing specific dates of deployment that can be corroborated by documentary evidence, as well as the conflicting information found within the military service record, the Board concluded there was insufficient evidence to recommend a change to the applicant’s record. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214. It states: a. for item 12f enter the total amount of foreign service completed during the period covered in item 12c. b. for item 18 use the remarks section for entries required by HQDA for which a separate item is not available on the form and for completing entries that are too long for their blocks. 3. Army Regulation 635-8 (Separation Processing and Documents), currently in effect, prescribes the transition processing function of the military personnel system, including preparation of the DD Form 214. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. It states for active duty Soldiers deployed with their unit during their continuous period of active service, enter only the statement “SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates).”
