ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS BOARD DATE: 14 August 2019 DOCKET NUMBER: AR20170008286 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty), for the period ending 30 November 2010, to show he completed weapons training (Beretta 9mm/pistol and the Company Commander and First Sergeant Orientation Course in item 14. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Certificate of Training FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, he believes it is an administrative error which was over looked at the time of retirement. All documents in his Official Military Personnel File supports his requested corrections. 3. The applicant provides a certificate of training for the Company Commander/First Sergeant Orientation Course dated, 11-15 May 2009. 4. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 30 November 1990. He served in Afghanistan from 15 September 2002 to 10 December 2002 and Iraq from 2 January 2003 to 1 May 2003, 1 September to 1 February 2004, 1 June 2004 to 1 December 2004, 1 May 2005 to 3 January 2006 and 17 August 2009 to 19 January 2010. b. The applicant’s record is void of any documentation which indicates he attended or completed Weapons Training (Beretta 9mm/pistol) or Company Commander/First Sergeant Orientation Course. c. The applicant was honorably retired from active duty on 30 November 2010. His DD Form 214 shows in Item 14 Military Education (Course Title, number weeks, and month and year completed): * Basic NCO CRS (BNCOC), 12 weeks, 2002// * Food Specialist, 8 weeks, 1991 * Hygiene/Sanitation, 2 weeks, 1991 * PR Leadership Dev CRS, 4 weeks, 1997 * SOC AM GEN Driving, 1 week, 2007 5. Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It provided that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service, providing a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found some relief was warranted. The applicant’s contentions were carefully considered. He provided evidence that shows he completed the commander/1SG course, and the Board agreed the course should be listed on his DD Form 214. His record is absent evidence that shows a weapons qualification for the pistol; therefore, the Board agreed relief for the weapon qualification is not warranted. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending block 14 of his DD Form 214 for the period ending 30 November 2010 by adding “CDR/1SG COURSE, 1 WEEK, 2009.” 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to adding weapons training for the Beretta 9mm/pistol. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. The regulation provided that in: a. Item 4 (a and b) (Grade, Rate or Rank and Pay Grade), to enter active duty grade of rank and pay grade at time of separation. b. Item 14 (Military Education), list in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214; e.g., medical, dental, electronics, supply, administration, personnel, or heavy equipment operations. Include title, length in weeks, and year completed. This information is to assist the soldier in job placement and counseling; therefore, the regulation instructed the preparer not to list training courses for combat skills. //NOTHING FOLLOWS// ABCMR Record of Proceedings (cont) AR20170008286 4 1
