The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, while on active duty, he tried 4 times to change his HOR to the State of Texas; however, it was never done. 3. The applicant enlisted in the Army National Guard (ARNG) on 12 June 1984. His enlistment document shows his HOR as Dothan, AL. 4. After a break in service, he enlisted in the ARNG on 4 March 1998. His enlistment document shows his HOR as Skipperville, AL. 5. He was honorably discharged from the ARNG and transferred to the U.S. Army Reserve (USAR) on 19 May 1999. 6. The applicant entered active duty as a member of the USAR on 7 November 2001. He was honorably released from active duty on 20 May 2002. The HOR on his DD Form 214 for this period shows Skipperville, AL. 7. The applicant reenlisted in the USAR on 28 November 2006. The reenlistment document shows his HOR as Fort Worth, Texas. Orders R-12-688325 issued by the U.S. Army Human Resources Command on 4 December 2006, released him from active duty and discharged him for the purpose of reenlistment in the USAR. He was reenlisted and ordered to active duty in Active Guard/Reserve status effective 7 January 2007, for a period of six years. His HOR is listed as Dothan, AL. 9. The applicant was honorably discharged on 9 January 2008, to accept a commission or warrant in the Army. The HOR listed on the DD Form 214 from this period lists his HOR as Dothan, AL. 10. On 10 January 2008, the applicant was appointed as an officer in the Army of the United States. 11. The applicant entered active duty as a Regular Army officer on 10 January 2008. He retired honorably on 27 April 2010. The DD Form 214 for this period lists his HOR as Dothan, AL. 12. The Joint Federal Travel Regulation (JFTR) provides that the HOR is the place recorded as the home of the individual at the time of enlistment or induction. There is no authority to change the HOR as officially recorded at time of entry into the military service. However, there is authority to correct a HOR if erroneously entered on the records at that time, and then only for travel and transportation purposes. Correction of the HOR must be based on evidence that a bona fide error was made and the HOR as corrected must have been the actual home of the individual at the time of entry into the relevant period of service. It must not be a place selected for the convenience of the Soldier. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents, and evidence in the records. The Board discussed the DD Form 214 in question and the previous DD Form 214 that both show the applicant’s place of entry into active duty as Dothan, Alabama. While the DD Form 214 show a mailing address in Texas after separation, there is no indication that the applicant entered active duty in Texas for either period of active duty service. Based on the JTR, the Board found insufficient evidence to grant relief; there is no evidence of an error or injustice. 2. After reviewing the application and all supporting documents, the Board determined that relief was not warranted.
