APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that he served in 1st Division, 26th Infantry Unit, Company A, 3rd Platoon, 3rd Squad, Team Leader for 1 year and 8 months then transferred to 207th Military Police (MP) Company, 5th US Army. He was proud to be a member of the 1st Division. 3. A review of the applicant’s service records shows the following: a. He was inducted into the Army of the United States on 1 November 1963. b. Special Orders (SO) Number 171, dated 17 July 1965 shows the applicant was reassigned from A Co 1st Battalion (Mechanized) 26th Infantry to 207th MP Company with a report date of 26 July 1965. c. SO Number 247, dated 22 October 1965 shows the applicant was released from active duty and transferred to US Army Reserve (USAR) Control Group (Annual Training) on 29 October 1965. His organization shows as 207th MP Company. d. On 29 October 1965, he was honorably transferred to USAR due to expiration of term of service. Block 12 shows as 207th MP Company, Fort Riley, Kansas – 5th US Army. 4. By regulation, Army Regulation 635-5 (Personnel Separations-Separation Documents) in effect at the time, prescribes the separation documents that will be furnished each individual who is separated from the Army and establishes standardized procedures for the preparation and distribution of these documents. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The applicant’s contentions were carefully considered. His record shows he served with the unit; however, as he stated, he was transferred to another unit prior to his separation from military service. The Board agreed there was no error or injustice in this case as regulatory guidance states that the last unit of assignment is reflected on the separation document. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
