APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that his primary MOS was 67V20 (Observation/Scout Helicopter Repairman). In Vietnam, he was made a door gunner and was then made a crew chief and promoted to specialist/E-4. He further states that his secondary MOS is not listed on his DD Form 214 which is 67A1F (Aircraft Maintenance Apprentice (Flight Qualified) – Door Gunner). 3. A review of the applicant’s service record shows the following: a. He was inducted in the Army of the United States on 16 April 1969. b. His DA Form 20 (Enlisted Qualification Record) shows in item 8 (Duty MOS) 67V2F (Observation/Scout Helicopter Repairman). Item 27 (Military Education) reflects helicopter repairman MOS awarded 25 July 1969. c. He served in Vietnam from 16 September 1969 to 23 May 1970. d. Special orders number 156, dated 11 August 1969, shows the applicant’s weapons score and the applicant's MOS as 67V20 (Observation/Scout Helicopter Repairman). e. Special Orders (SO) Number 158, dated 13 August 1969, transfers the applicant to Fort Lewis, WA as his new duty station and show the applicant’s MOS as 67V20 (Observation/Scout Helicopter Repairman). f. SO Number 257, dated 14 September 1969, transfers the applicant overseas to Vietnam and shows the applicant’s MOS as 67V20 (Observation/Scout Helicopter Repairman). g. SO Number 266, dated 23 September 1969, assigns the applicant to a new organization and shows the applicant’s MOS as 67V20 (Observation/Scout Helicopter Repairman). h. SO Number 37, dated 6 February 1970, assigns the applicant to Troop Delta, 1st Squadron, 10th Calvary and shows the applicant’s MOS as 67V20 (Observation/Scout Helicopter Repairman) and promotes him to specialist/E-4. i. No documents could be found in the applicant’s service record that confirm the award of a secondary MOS of 67A1F (Aircraft Maintenance Apprentice (Flight Qualified) – Door Gunner. j. He was honorably released from active duty on 18 June 1970. His DD Form 214 shows in item 23a (Specialty Number and Title) 67V20 (Observation/Scout Helicopter Repairman). It also shows that he completed 2 years, 2 months, and 3 days of active duty service. 4. Army Regulation 614-200 (Enlisted Assignments and Utilization Management) states that Soldiers will be assigned to an organizational element according to the authorized MTOE (Modified Table of Organization and Equipment) (/TDA(Table of Distribution Allowances)/DMOS (Duty Military Occupational Specialty) ( positions, consistent with their PMOS (Primary MOS) or CPMOS (Career Progression Military Occupational Specialty) qualifications. 5. AR 635-5 (Separation Document) paragraph 2-40 states that item 23a and b enter primary MOS code number, title, and date of the award. In addition, enter PMOS evaluation score and date of score. If the enlisted person has not received a PMOS evaluation score enter “None”. If more space is required, enter “see 30” and continue remark in item 30. If the specialty represented by the MOS has a related civilian occupation, enter in item 23b the appropriate job title and code number from the Dictionary of Occupational Titles. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. No documents could be found in the applicant’s service record that confirm the award of a secondary MOS of 67A1F (Aircraft Maintenance Apprentice (Flight Qualified) – Door Gunner. The DD Form 214 reflects the primary MOS held by the Soldier at the time of separation. He has various forms reflecting him as 67V but none showing award of MOS 67A. Board voted to deny due to insufficient evidence to show he was formally trained or awarded MOS 67A. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 614-200 (Enlisted Assignments and Utilization Management) states that Soldiers will be assigned to an organizational element according to the authorized MTOE/TDA/DMOS positions, consistent with their PMOS or CPMOS qualifications, and—(1).
